When you apply for i-751 removal of conditions

Timeline

Hi there the CO advised me at the time of my POE that i should send in my i-751 removal of conditions 6 months before the expiration of my GC I'm soon approaching this date any advise does it usually fall in that timeframe? Should I send sooner?!

The earliest you can apply is starting 90 days before the expiration date of your conditional green card

I see that but at my POE the customs expressed that it's important to submit 6 months in advance so I just wanted some feed back on people's experience I guess and the timeline etc...

Well he doesn’t know anything about USCIS policies/immigration law. You can send it earlier but your application will be rejected and sent back to you.

No, your application will be rejected, you can only apply a joint i751 application WITHIN 90 days before your conditional green card expires. If you check the i751 instructions you will see when you can file an i751 application https://www.uscis.gov/i-751.

 

In fact you MUST file within the 90 day window otherwise you will be late or too early. 

 

Between now and when you can file you can collect bona fide marriage proof to submit with your i751 application. Joint Tax Return transcripts for each year of marriage, joint lease, copies of state ID with same address (driver's licenses), w2 or 1099 docs for each year married show common address, joint bills, joint bank statement for each month of marriage, birth record of children together, photos together, proof of travel together, even copy of mail sent common address, and so on.

 

A i751 waiver case can be filed at any time, but the joint l751 must be filed within 90 days of CGC expiration.

Sending 6 months early does not apply to removal of conditions.  As others have said, the very earliest USCIS can receive a joint I-751 package is 90 days prior to expiration of the 2 year conditional card.  If CBP told you something different, ignore it.  

Note : I would not send the I-751 package until a couple days after the 90 day window opens.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

He is incorrect and it would be rejected if more than 90 days prior to expiry of your 2 year card....unless it is a waiver (divorce/abuse) filing, which can be submitted & will be accepted before or after the usual 90 day window without explanation or penalty

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Don't send it prior the 90 Days window, I sent my I-751 5 days earlier from the 90 days because I got scare that due COVID the shipping process would take longer, they received in two days after I send it, they rejected all and send it back this delayed my process almost 2 months.

My cousin package arrived one day before of 90 days and it was rejected. Then he has to submitted again

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

I see that someone has a date calculator in this thread.

Personally I say don't try to be smart to get exactly 90 days. Drop it in the mail at the earliest 89 days else you will up having to resubmit.

 

I don't know which time zone USCIS uses. Also if they use the postmarked date or the date of arrival.

 

89 days folks. That's when I will drop it in the mail.

If you have a 2 year conditional green card you file an i751 to remove the conditions within 90 days of the expiration of the 2 year card. You get an extension letter for 2 years, most ROC LPR cases are approved within the two years and you get a 10 year green card after ROC approval. 

 

You can travel, get a job, or renew a driver's license with the old expired conditional green card together with the expired green card. 

When you apply for an i751 your LPR status does not expire, only proof of your continued LPR status expires. Only an immgration judge takes away your LPR status.

Ok so let's say after 1 year goes by putting me at 3 years as a LPR but I still haven't received my 10 yr GC can I still apply for my citizenship?!

As long as you are still married you can file for naturalization at 3 year mark with an open I-751 case.
