Embassy Interview while I'm stuck in the US

Even if there IS another fee, the lawyer is the one who knows everything about your case, and can be sure of giving you the correct answers based on your actual facts and circumstances.

According to @arken filing the I-824 is not required. 

If @SusKes is still around they can confirm what they did after being scheduled for an interview.

Yes, what @arken told was correct. You don't need I-824. 

Since, I don't wanted to travel back to my country (due to pandemic) I cancelled the interview at my Embassy and applied for I485. Did my biometrics for i485. but no updates after that.  It's more than 4 months now. Wish I could have travelled back and finished the interview.

It was 15 years ago, and adjustment from K3 and K4 visas, but my experience was no I-824 is needed in this kind of case.  USCIS doesn't have the I-130 in storage.  They go ahead and join it with the rest of the Adjustment package before sending the case to the local office.  This may mean it will take longer to complete the AOS, but it should not impact the timeline for EAD and AP.

Yes, I understand. I have done the biometrics also, and it looks time 12 months + + wait time for me.

Me too I wish I could have gone back in December as we originally planned.

Thank you all!

I simply went ahead and canceled the interview at the Embassy anyway as they require at least a 7-day notice.

I just heard back from the lawyer this morning, and she said that I could just ignore the interview and I did not need to do anything as USCIS and the NVC doesn't communicate.

 

We bumped into another issue and I will make another thread on that.
