CJ,

State DMVs generally want to see evidence that an alien has legal immigration status in the USA and want to see something with an 'until' date on it for someone who is not a LPR. An EAD works in most states.

Yodrak

Hey Everyone,

I have some questions. Jum has her learner's permit for driving that was obtained prior to our wedding. The expire date of the learner's permit was her Visa expire date of Aug. 6th. Now she is ready for her driver license exam and will do just fine. However, in order to get past the hurdle of the expire date of her learner's permit I have some questions. We have all of the good stuff like certified copy of marriage certificate, Thai birth certificate, passport, and all of those types of things, but the DMV wanted to see her permanent residency card. I think that doesn't come until 1 1/2 - 2 years down the road after adjustment of status is approved. Does anyone else have any experience with this? Thanks for your help!

CA DMV will not issue an ID to Ton until they see an approval notice for the AOS.

Dan,

This information is too late for Ton but perhaps for any others (in California) I hope this helps someone in the future....

When my wife got her SS Card/Number (about a month after entry to USA) she immediately applied for her CA ID. (This was done prior to us getting married and her passport still has K-1 visa valid and I-94 attached )

here is a post from another website I'd like to share regarding my wife getting an CA ID :

We went to the local CA DMV this morning and applied for her CA ID. We first checked in the START HERE line and the lady gave us the DL 44 form and requested to see Poc's Passport and SS Card. She was not sure that Poc was qualified because of the expiration date on the I-94 was about to expire in April. She gave us a number and said we'll find out when they check their database.

After waiting 10 minutes, we were called up. The DMV worker checked the passport and had to verify with her supervisor about the expiration date of the I-94. Supervisor saw it was still valid and had emphasized to the worker so long as there is a day before the expiration date, CA ID can be issued.

We paid the fee $21.00, then the worker asked for the SS card and checked her database. After she had made photocopies of the Passport and SS card, that was it...Poc signed the form then went to get her thumbprint & photo taken. The ID should be in the mail 2-6 weeks.

She got her CA ID in her maiden name , then after marriage, she went back to get the ID changed to her married name.

I wish the question would of came up sooner for me to post this for you and Ton....in any case hope she gets her AOS approve in a timely manner...good luck

regards,

George

Hi Everyone,

Well, its offical, Chutima and I are married! It took long enough, but it was worth the wait, although I could have done without the cost! :P

I have also received a job offer for a new job in Florida, so it looks like we're moving to the mainland. We were just there last week for the interview and to check out the area. Chutima and I both love it there, and we will be able to buy a house no problem! It is so much cheaper in Florida than Hawaii! :D

Here are some of the wedding pics! Wedding Pics

Dave,

What is it that you are concerned about? What prompts this question?

Yodrak

Is it important to go to the amphur and get a letter from them saying my finacee is single? Or will a updated id card work if it says, "Ms" on it?

Do I need this?

Thanks,

Dave

Yodrak,

Nothing really. I just want all my bases covered. I want to make sure I don't get caught by anything. Our interview is in about 10 days and I will be joining her in Bangkok for it. I don't want the needle in the haystack to ####### me. So another fear: does the dates on the I-134 matter (can they be notorized after she sent in packet 3 checklist and Ds-230 part 1 in). I want to re-adjust this form before I go, seems like I gave incorrect information on the surrendor value of my Life insurance policy and don't want this to invalidate the form. So I want to get another one done on Wednesday!

Dave,

My sense is that being asked to submit a 'single certificate' is rare and unusual.

You should provide your fiancee with current and accurate financial information. It does not matter if the documents are dated later than the checklist.

Last week our EAD (which was approved in April) was touched 3 times, Our AOS, was touched on the 18'th so we decided to give them a little more time before calling customer service.

Yesterday we called and were informed the we are definitely outside our processing time. The csr took a bunch of information and will contact the DO to see what the holdup is. She gave me a tracking number and said if we did not hear anything in 30 days to call back.
