Swaasdee all,

We have an interview on August 7th at 7 am. Man I'm excited but also scarred. I thought that I needed a co-sponsor for a long time with the 1-134 but now I'm told I don't need one. I make right at 30,000 dollars a year and have 4000 in savings with a life insurance of 50,000 and cash value of 1500. I've been supporting my thai GF for over a year now and have receipts to show this from my bank. My concerns are:

Do I have enough info:

I'm going to the interview to be with her. I'm bringing the I-134 with statements from my bank history for 1 year, two letters from employers, a job offer for her to work in the USA, H&R block tax receipts for 2005, 6 pay stubs. I also have all supporting relationship stuff like emails for 1.5 years, letters, photos. She has all her checklist items with passing grades on all.

What if they don't accept my info:

My fear is that even with my tax reciepts they don't accept my job. I work in restaurants and generate my wages on tips. My income is 30,000 plus but with traveling to Thailand so much, my savings is poor with no 401k stuff.

What else should we be thinking about:

Anyone have any ideas about anything I can do?

Thanks Dave

Dave,

You should be thinking about this - Thai people are quite capable of supporting themselves, but there is a group of Thai women who are inadmissable to the USA because they are being supported by their farang boyfriends.

Watch out for double-edged swords.

You have more than enough. Nothing to worry about as long as your Tax records show you made more than the minimum requirements. (Did you declare your tips?) Make sure you get the I134 from notarized.

I declared my tips mostly: My earnings reflect this on my taxable so I made 29,890 last year from salaries, tips, all earnings.

To the other poster: My GF graduated from Payap university had a job at the sheraton, a couple other places then openned her own shop in the night Market in Chiang Mai. She sold her shop last year for 100,000 baht. I asked her not to get another job because in September until December I was planning on spending 3 months in Thailand and wanted her to travel with me. Right in the middle of August we applied for an H2B visa for her to work with my restaurant in America; they hire alot of h2b employees and she was offered a job. Yet when she went to the embassy she was declined. I went back to Thailand in April of this year until June to travel with her again. However, had filed our F-visa in mid feb. durring which time she built a house for me in Mai Sai. So she sold her business took 6 weeks off. Joined me for traveling around Thailand, Vietnam, Cambodia and Burma from Sept to December. Worked on getting a H2b visa was declined then built a house for us in Mai sai then joined me for more traveling in April to June. Mixed with visa applications and supporting documentation when did she have time have a real job. She wants to work in America which I want to teach her how how to be a great server and make good money.

I'm not sure if H&R Block tax receipts will be accepted, I would request tax transcripts from the IRS. While you are requesting them, you may as well request the past three years transcripts as they will be required when you file the I-864 for AOS.

Ty,

I called the IRS but they didn't know what I was talking about. From H&R block I have my tax sheets along with notorized original and notarized copies of my W2 forms. I have the letter from the IRS about not getting my taxes done by April 15th with interest and penalyt info. I then have a copy of the check front and back of with full payment of their requested amount. If this isn't enough and I need more how do I get a tax transcript?

Thanks,

David

David,

I don't know which number you called, but getting tax transcripts is very simple. Just call (800)–829–1040 and follow the directions. You will need to provide them some information, and they will mail your tax transcript to you, and you should have them in about a week.

Ty,

No, 3 years of tax returns or transcripts are not required with I-864. The one most recent year is required.

But one can submit any number of years worth that they wish to give the best picture of their financial situation.

Yodrak

.... you may as well request the past three years transcripts as they will be required when you file the I-864 for AOS.

Ty

David,

You need a complete copy of your most recent tax return, 'complete' as in a 1040 including any attachments such as Schedules, W2s, 1099s. Or an IRS tax transcript, which others have posted how to obtain.

Notarized copies of W2?

Hi Everyone

I have a little problem with the birth certificate with my fiancee's daughter. Eventhough, my fiancee's daughter is not seeking k2 visa. At the interview on July 12 2006, the consular requested the original or certified copy of my fiancee's daughter birth certificate. My fiancee has only the copy, and the Amphur will not stamp the copy until she has the original to support. Also, the Amphur has issued her the new one from the copy one, the embassy staff woman in window 5 was very nasty and rude. Now we are clueless and lost on what to do. Can my fiancee reapply for the original birth certificate? This is the only problem that holding up her visa. Please, help...I would be deeply appreciate it very much if someone could help us in this matter.

Bill,

I don't understand what you mean by "the Amphur has issued her the new one from the copy one" Does your fiancee now have an 'original' or 'certified' birth certificate for her daughter (a certificate with the big red stamp on it in several places) or doesn't she?

One of the things that held up Rodjanaa's K3 visa was that she no longer had her original divorce certificate - she had to surrender that to the amphur when we registered our marrigage. I had enough foresight to make some photocopies of it first, but that was insufficient. After the visa interview she went back to the amphur where we registered our marriage but they had already destroyed to original divorce certificate. However, they did put the red stamp on several of our photocopies to certify them. That satisfied the consular officer.

With regard to birth certificates, Rodjanaa does not have her birth certificate - it was lost years ago. The amphur would not issue her a new birth certificate but they did give her a statement on the official stationary (the paper with the Garuda at the top) that said she was born in that amphur, gave the date of birth and parent information that would be on a birth certificate, and stamped it with the red seal. We've had no trouble using that as her birth certificate.

Hi Yodrak

Sorry if I didnt make it clear on my last post. My fiancee DOES NO have the original or certified copy. She has only the copy without any stamp on it. When she went to Amphur to get it stamp, they won't stamp for her because she does not have the original to verify. Her ex-husband has the original copy, but he won't give it to her, he want to see her suffer. So, the Amphur took the copy (no stamp) that she has and made her a new copy with red stamp on it, but in defferent format. But the embassy staff (lady in window 5) refuse to take it because it was defferent from the one (no stamp) that we have submitted at the interview. Now, I don't know what to do. I told my fiancee if she can reapply for the new BC.

Bill,

I would think that your fiancee needs to be more assertive with the person at window #5. It's not that person's job to assess the information, just to accept it and direct it to the appropriate consular officer.

Failing that, she might try mailing the new document to the consular officer's attention.

Or, you might try contacting Bill White for suggestions on how to deal with the person at #5.

Hi Yodrak

Yes, my fiancee need to be more assertive with the person at window #5. But she is scared about that woman may mess up our paper work. So, she just takes all the papers back. By the way, Bill White is my lawyer. He wanted to take the papers to the embassy, but my fiancee thought it is just a matter to turn in papers, so she went by herself and got chew from window 5. One nasty and rude woman. Mr. White will take the paper again maybe on wednesday. I hope it will work out this time.
