Yeah, I am hoping that they will take the pay stubs and a letter from my employer. I have seen other posts on here saying that they will only take tax records, bank account etc. etc.

You can't provide tax records you don't have!!! So don't worry!

I guess I'm just freaking out because of Lotuspearls getting denied. Looking at the I-134, it doesn't even say anything about tax returns unless you are self-employed. Statement from my employer will not be a problem.

The packet 3 checklist from the embassy for K visas does require a copy/transcript of the last year's tax return.

http://bangkok.usembassy.gov/root/pdfs/k_visa_packet3.pdf I have mentioned this a number of times in regards to the 2007 tax return: My son was told to write a notarized letter clearly explaining his situation and to back it up with documentation.

I provided, in duplicate, the following evidence:

Letter from employer

My two most recent pay stubs (at the time)

Copy of the previous years W-2 forms

Copy of the previous years 1040

Copy of my bank statement

Copy of my retirement account

Copy of my brokerage account

If I had known then, what I know now, concerning how easy it is to get a tax transcript from the IRS, I would have called their 1-800 number and had them fax me a transcript instead of sending in a copy of my W-2s and 1040.

I don't know the exact details of why lotuspearls got denied, without knowing what evidence he provided, and what his finances are.

The real test is the I-864 needed for AOS.

At this point, they just want to make sure you are financially capable of supporting your fiancee and that she will not become a burden of the state.

The immigration process is not one that people without sufficient income should attempt, because it alone is very expensive. Money is a must have.

It seems stupid in a way to make you prove you can support your fiancee when there is nothing in the world that stops them from going on financial aid once they are legally in the USA!! I know they are trying to prevent that, but gee, I see young mothers in court all the time who are having babies at 13, 14 yrs. old and where do you think they get the money to support themselves? Certainly not from the guy that knocked them up but welfare that we all pay for!!!! And look at all the illegals from the Mexican countries that are here that live off our tax dollars. Just my two cents!!!

Saturday won't get her fast enough so I can get on that plane to THAILAND!!!!!!!!!!!!!!!!!!!!!!!!

In order to become a Permanent Resident, you will have to fill out and submit an I-864, which makes YOU responsible for paying back any finacial aid she receives. The affadavits of support are very serious, and are intended to not allow an immigrant to get a free ride.

Ok. Here is a good question. What is the best procedure if your fiancee does not want to live here but comes over on the fiancee visa and we get married. Yes, I know she can return but I don't want her to jeopardize being able to travel here in the future. Is filing AOS and gettng AP the only option or is there a better way to conquer her fears of her daughter going bad while she is away for 5-6 months? I'd like her to be able to travel here some before I retire again in 2-3 years and move over there.

You must file AOS and AP. It would be advisable for her not to leave until she has her biometrics appointment at your local ASC. The sooner you get married, the sooner you can file. I would hope you already have a head start on the paperwork and documentaion required.

Rather than going through this whole process, did Wariya ever even attempt to get a tourist visa? Having kids over there is a strong connection, which is important for a B1/B2 visa.

Agree with roi_aggie. You have to file AOS and AP after getting married. Once she gets her AP, she will be free to travel and re-enter the USA, but she will have to come back for the AOS interview (unless you are one of the fortunate ones that get approved without interview).

It's hindsight now, but had you married in Thailand and then filed K-3 instead of K-1, she would have received a two year, multi-entry visa. AOS filing could have waited up to 21 months from visa issuance.

Is it possible this is a K-1 vs. K-3 thing? I am over the limit for every year since 1990 EXCEPT last year. This year I am making at least 4 times the requirement. I noticed that Thai Family didn't have an issue. I can get a co-sponsor for last year. I wonder if they will accept my current years income, even though I haven't received a W-2 yet?

Any advice here?

I heard lately that many Thai women went to interview and they have not got visa yet.

Becasue from thier fiance's income are not enough.

The Embassy is not accept a co- sponsor.

But the Embassy give opportunity for them that they can have other assets to show, like stock etc

If don't have, have to wait until get new tax return and have income enough

But co-sponsor can use for CR1 and IR1 Visa
