For the K visas the NVC receives the approved petition from the USCIS, assigns a DoS case number, and forwards the file on to the appropriate consulate.

The NVC does not evaluate what's in the file. Whatever is there they send to the consulate.

Would you folks say NVC expects things to be there no matter what?

Bill, Did they ever ask for her marriage certificate. My fiance was married and now divorced. I have her decree translated and certified. However, I only have a copy of her divorce decree.

Sorry, somehow I missed this question.

The instructions for packet 4 say that all of the documents must be submitted in a specific order, and 'one original and one copy'. Pao had her original marriage certificate and the original certified statement regarding her divorce, and we submitted these with copies as requested. (When she went to pick up the visas. they returned the originals).

From a more practical standpoint, I should think that a "copy of a copy" of a marriage certificate would do in most cases, (and may not even be required on a fiance visa), but I do think you need someting origninal and certified regarding the divorce, along with a phtoto copy of the original certified divorce document. I should think they'd be more concerned with having an official divorce document since that would, in effect, document both the marriage and the divorce. You may want to have her go to Amphur and get a 'single certificate' if you are going to use a copy of a divorce decree. At first, the Consular Offical wanted this from Amphur to supplement the documentation that I provided, but then wavied that request too. My situation was a little more complicated since Pao has a 7 year old daughter that will accompany her and the date of the marriage was important in our case, since different rules apply to children born out-of-wedlock. Had Pao been married at the time Wynne was born, we'd have had to show she had legal custody of her daughter; where as legal custody defaults to the mother when a child is born out-of-wedlock.

My story is sort of involved, as the Consular Offical wanted a statement saying that Pao was single at the time her daughter was born, which Amphur said they could not do. The 'single certificate' is designed only to show that she is 'currently single'. I suppose if push came to shove we might have been able to get some sort of statement from Amphur that Pao was single at the time her daughter was born, but I simply argued with the Embassy that it should be obvios, since we had the certified marrage certificate which show she was married after her daghter was born.

In your case, I am not even certain that the marriage certifcate is even needed if she is divorced. It seems to me that some of the Packet 4 forms could be and probably are used with the I-130 filers, (for someone bringing their wife from over seas).

Yodrak is most knoledgable about these matters and could probably shed more light on the matter

I have few questions, knowing that our interview is coming at the BKK embassy.

For the Thai citizen's birth

certificate:--Is it suppose to be

translated into english for the

interview, or not?

On the I-134- The 'Oath or Affirmation of

Sponsor' says: "I swear (affirm) that I

know the contents of this affidavit

signed by me and that the statements are

true and correct." Is only the 2 paged

I-134 form to be notarized or, is all

supporting evidence accompaning the I-134

Such as: tax returns, W2's, statement

from employer, statement from financial

institutions required to be notarized as

well? As I see it, the I-134 form signed

and notarized affirms that any and all

supporting evidence attached to it will

be true and correct as well. Chai mai?

G-325A form fiancee--I originally filled

in --/--/1939 for her Father' birthdate,

actually it should be --/--/1936. What do

you think? Should I send some appendice

along with all the other info for the

interview explaining this screw-up, or

should I let it slide?

Only the I-134 need be notarized. Supporting docs do not need it. You will need Certified copies of your tax returns from the IRS which you can reuest at their website. The employer letter should be on company letterhead and have an original signature. The financial instution statements should be on bank letterhead and orignally signed,if possible.

Truth to tell, I don't think the embassy or any other gov't agency verified my wife's parents DOB. You can always add an attachment explaining the DOB mix up, if you like.

Thanks Bill, Thats sounds reasonable to me. She does, or I should say, I have her divorce decree with the stamp and an english translation.

My real problem is I screwed up on the I 129F. I did'nt realize that she had taken his name and so did not indicate that on the petition. The divorce decree makes no mention of her accepting his name but the marriage cert does. If I don't have to present the marriage cert then the embassy should not have any questions about this. I am trying to avoid a situation where they say they need to prove she changed her name in a foriegn country. It would create delays.

I read something somewhere about 'secondary processing' - what is that and does it have anything to do with the POE? What should we expect at the POE?

Bill... Unless you are going through JFK and planing on getting tempt EAD there I dont think there's anything to worry about..

I heard that it's better save to not wear a wedding ring though... I dont have one anyway (just the engagement ring) so they wont have any doubt.. but i'm sure everything will be fine

Hi Gang! It's been a while since we've visited this site. We are still waiting for Wisakha's green card, they say it's due to us moving into a new home and the change of address forms. They emailed us in November saying, "it could take up to 6 additional months"!

We are not worried though, She is now going to Florida Atlantic University, taking a few English classes. and we recieved a couple of forms allowing us to go to Thailand twice! So we are going next month to announce to her family that we are having a baby!

We would like to have her sister come and work for us as a nanny and help us with some bookkeeping in our business.

Can anyone suggest the best way for her to come here!

Also, We are flying in and out of JFK airport, I wonder if they can help my wife get her green card quicker?

Pao is packing as I type and I am wondering if she needs to make any special declaration regarding all the personal effects she will be bringing with her to the USA. We will be leaving Wednsday at 8:30am Thailand time, that's Tuesday evening US time, give or take a few hours, then its a little over 20 hours from Bangkok to Tucson.

When Ying came to the US for the first time (almost 2 years ago) we had the maximum amount of luggage and she did not need to declare anything. We did get asked if we were bringing any food and our bags were x-rayed but were not opened.

Have a safe trip back to the US!

For the visa for her sister to come be a nanny.. it's gonna be difficult since she is a "young lady" I would think that her sister can be an aupair through the program and you guys enroll in the same program too... it's gonna be a lot more expensive though so this might not work.. so i dont know.. sorry

I didnt have to declare anything.. Bram used to say that for someone who immigrate to the US the first time in the country they dont need to pay any tax (house hold goods.. we ship stuff in and no tax woo!) :blush:

I am lost and my fiance does not seem to know what to do either. She has packet 3 now. But we don't know what to do from here. Does she just fill in the DS230, only part 1?, and send it back to the embassy? When does she pay the fee, what else gets sent in?

I would be enormously grateful if someone could outline this process for us. Thanks.
