K3 speeding up I130. Lawfully info on 748 cases

Lawfully has info on 748 K3 files. 

 

On average, 71% of K3 files get a "case was denied" 88 days after case was received. This insinuates that it does speed up the I130. No guarantee of course because it could have been approved regardless within that timeframe but I think three months is not a lot and many send the K3 in the beginning of their process. 

 

I think it definitely helped my process, although like I previously said, my typo correction when it was on AR surely helped. I am absolutely certain on that because VSC as opposed to other SCs does not AR and then AR again two days later but rather 2-3 months later, based on so many timelines here and on FB. 

 

It's a very small sample size but thought it was cool to see.

That would be true only if the I-30 was approved when the I-129f was closed.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hard to say.  Not every I-129F administrative closure results in an I-130 decision.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Perhaps. Which is why it's merely an insinuation and nothing more. Bearing in mind that it is free, I really don't see the downside of filing it. It FEELS from FB like at certain SCs it REALLY works, like Texas.

It has worked for some.  There is no question about that.  At one time, a few years ago, it worked for some people at Nebraska SC only

How soon after I-129F was denied is the I-130 approved. Do you have that data?

 

I've been looking at Vermont and the numbers are all over the place. 

The majority of cases are approved in the 250-260 day range (175 working days) but after that cases between 180-200 days are approved. I haven't been able to see which cases filed K3 or not because not all members write comments informing us of their actions. 

I can't say with certainty the K3 helps a case because we have a member going through Vermont who has been in AR for 5 months and sent their K3 in fairly early. 

 

On Facebook members are saying K3 only works if you send it in AFTER you go into AR. No one is actually examining approvals and how they happen.

I know that sometimes happens, which makes no logical sense.  Why should an I-130 associated with an I-129F be given priority over other I-130s which have been in the system for months?

Out of the last 173 cases 23 cases were approved between 240-259 days. After that the next highest approvals were between 180-199 days (14 cases). 

But cases under 180 days are approved too. In your range we have 6 cases approved. 

We don't have enough data to make an informed opinion.

If we know the K3 cases were denied and then I-130s were approved soon after and a lot sooner than the cases out of the service centers I would be confident in recommending people file an I-129F.

The problem is there are 5 service centers with different approval timelines and your timeline is not an outlier.

Did you actually count them or is there that info somewhere that I'm not familiar with?

Counted them based on VJ stats. 

I'm trying to figure out a method to the madness but not everyone on VJ reports filing of K3.

I went to the site and clicked on each of the status bars

even the 3% that were approved said the DOS  sent the K3 to  USCIS for further review

71% is high -looks like this doesn't work

The idea is filing a K3 forces them to look at your I-130 and they approve that case several months before the usual timeline for the I-130 from your service center. 

Example: Most Vermont cases are approved between 250-260 days. 

Snirgeu was approved after 146 days. Snirgeu filed the K3 and believes this could have speeded up their I-130 approval. 

K3 was accepted mid December, active review occurred in February and was approved a few days later. 

6 other cases from VJ were approved between 140-159 days.

Did all of those members file K3s? 

If they did there might be some merit to the idea K3 helps speed up approval. 

Either way, I think filing a K3 is actively harmful to the process for the collective.

It doesn't cost any money for the filer BUT it does take time to input the data, and officers have to link the petition to an existing I-130 and review the submitted information. 

I see "748 K3 cases denied" and think "748 extra I-130s that could have been approved".
