Confused about what documents I need to submit. (merged)

I'm going to be filing the I-130 online. I know I need evidence. I believe I file the I-130A on there too. 

 

But what confuses me is what comes after. My husband is from Sweden and I'm a US citizen. I have seen people say that I should file I-485 when I receive the I-130 receipt. I have seen people say that I should file it when the NVC asks for the I-864. And some people tell me I don't need to file that form at all as it's a AOS. Im genuinely confused at this point. Do I file the I-485 and when?

 

 

Another question I have and I want to confirm I have it right is, is the NVC the one who asks for my I-864 after my case is approved by the USCIS? 

 

What other documents do I need that I'm missing?

 

Does my husband need to submit his birth certificate copy's or just a copy of his social security card? He doesn't have a birth certificate on hand and Sweden doesn't generally do birth certificates according to him.

Process depends on whether the non US spouse is living overseas or has legally entered the US snd is currently here ..  which situation is yours? 
 

There are specified documents from Sweden which are required including one which is required as the “ birth certificate “

Your husband needs his birth certificate equivalent ( Personbevis) if he is adjusting status or going through NVC

Document Name: Extract of the population register (“Personbevis”).

Issuing Authority: Swedish Tax Agency (“Skatteverket”).

Special Seal(s) / Color / Format: On white A4 paper format, stamped with a small round seal with the Swedish Tax Agency´s logo.

Issuing Authority Personnel Title: Registration Officer (“Servicetjänsteman”).

Registration Criteria: None.

Procedure for Obtaining: For a complete version, one must call the Swedish Tax Agency. The complete version should state the applicant's date and place of birth, the names of both parents, their marital status and their date of marriage, if applicable.

Certified Copies Available: Yes.

Alternate Documents: Birth records for persons born before July 1, 1991, can also be obtained both from the parish office (“Pastorsambetet”) in the parish of the applicant's birth. This record is only provided in Swedish.

Exceptions: None

Hi, he is living over seas, he isn't in the USA right now either.

Where can I find the documents required from Sweden? I'll have to make sure he gets that before I file then. Right now I'm still in the gathering information and things I need stage.

First you file the I-130 and I-130A. You can file it online. 

Your husband will need Personbevis and Police Certificates at NVC stage. 

Read the guides to understand the process. 

It takes 1.5-2 years.

So if I'm reading this correctly our marriage certificate and birth certificates are required until but the police records aren't until the NVC stage?

His birth certificate isn't required yet.

You need to provide proof of US citizenship with birth certificate or passport. 

Then you need to include proof of bonafide marriage/ relationship.

I see, so the I-485 isn't in the picture for my case right? Looking at the page you sent I realized I have the wrong/not official marriage certificate. Good thing I wasn't sending it in yet! He can easily get the right one but it's confusing the one the officiant gave us isn't the correct one. It is apparently the same paper as his birthday certificate (personbevis)

Correct I-485 is for adjusting status. 

It is required when the beneficiary is already in the USA.

This is my checklist/timeline of things to do for the CR1. My husband is residing in Sweden and is a swedish citizen and I am in the us and am a US citizen.

 

-obtain 2x2 passport quality photos for the both of us.

-pictures of birth certificates

proof of marriage ( I will probably make a separate post about this because I have questions about what I need.)

- I-130 online along with the I-130A

-marrriage certificate.

 

So first I file the I-130 with the I-130a online.

I submit all the required documents. Does it have specific sections to upload each required document (passport quality photos , birth certificate.. ect? )

 

Then I attach proof of relationship.

 

 

At this point I pay the filing fee and wait until it is approved and I get a letter from the NVC.

 

Now the NVC will send me a request of I864. I have to submit DS 260 and DS 261 also in the mail. Do I mail them all together? 

 

After this a interview in my husband's country is scheduled at a US EMBASSY. he should bring all original documents with him as well as all the proof of marriage we have. He has to get a doctors visit at the approved doctor and bring that.

 

 

After the interview they will tell us Yes or no and he will receive a envelope he can use to enter the USA.

 

I am also under the impression the Biometrics appointment is after the interview since he is not in the United States? When exactly does this happen?

 

 

 

 

I am not supposed to file the I-675 I-145 or I-131 because he is not residing in the USA currently. The green card automatically gives him work and travel authorization right?

 

Sorry for all the questions, I'm just trying to make sure I have everything! It almost sounds too easy to be true and I feel like I'm missing something, I thought I'd have to file like 20 different forms lol.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

u don't need I 675 with CR1 / u are authorized to work as soon as I 551 stamp is on visa passport at POE

u don't need I 145 or I 131 

u will later apply for ROC to remove 2 year grreen card restrictions
