Hey everyone,
Is it true that petitioner has to be in the US at least 4 months prior to the interview date of his spouse? I'm asking this because I read that in some other groups and it made me very worried. My husband and I live together in Turkey and he works for this American company remotely ( his job had been remote even before the pandemic), he pays his taxes, has the American driving license, and his mail address is his parent’s address where he used to live before we moved in together in Turkey. I wanted to know whether these are enough evidence for proving domicile or not? Also would be a problem if he was in Turkey the day of my interview ?

I would really appreciate it if someone can help me.
Thanks

There is no such 4 months precedents. Seems sufficient. Add a signed and sworn statement from him that he intends to domicile in the US. Lots of people travel together to the US.

My understanding is the USC and immigrant can travel into the US together

misunderstandings are for those who need to establish US residency

if petitioner has kept the DL and US address (US bank accounts help) then no issue

I agree with @arken , there is no 4 month requirement for re-establishing domicile, and your evidence seems sufficient.  The only requirement I know of is the intending immigrant spouse cannot precede the USC spouse to the US with their visa, you can come at the same time, or the USC spouse has to come first.

Good Luck!

Hi everyone ,

It's been 3 years and six months that my husband (US citizen) and I (Iranian) have lived with each other in Turkey and it's been 2 years we have been married. Recently I got my interview letter and it's in less than one month from now. We are really concerned about domicile proof since my husband haven't been in the US during this time but he has been working all this time as his job is remote and paid taxes. His mail address is still his parents' house where he used to live before he moved to Turkey. I list what we can provide as domicile proof and really appreciate it if you guys tell me whether it is sufficient for this matter or not.
- US address bank statements

- US credit cards statements

- Tax transcripts

- W2 from the US based company where he works

- US driver’s license

- Pay stubs
