Hi everyone, I am here on a K3 visa and I am sending my AOS shortly?

I don't intend to work while here is the US. Can I file for a social security number without having and EAD?

Yes you will need a EAD to get a SSN if you came here on a K3....

hi all, i am incredibly confused!!! i read the guide and it didn't help much.

my bf entered on his k-1 visa on 11 july. so we want to get him an ssn, i called the social security administration and they told me they would not provide him an ssn w/ a i-94. he did not get a work authorization annotation upon arrival just the line about fiance to me etc. so am i required to file ead first? i was lead to understand that the visa holder was allowed to work w/ a k-1 and eligible for a ssn?

any help would be greatly appreciated. i am sure i am the only idiot who doesn't get it but my high priced attorney is no help sadly.

He doesn't need to have a work authorized I-94 since he entered as a K-1. He just needs to take the I-94 that was entered in his passport (still in his passport, of course) while it is still valid and no later than 3 weeks prior to the I-94 expiring (it is valid for 90 days). As long as his name has been entered into the SAVE database (verifying his status and that he legally entered the US) they will accept his application and send him a SSN. He should be in now as it takes about 3 weeks or so after he enters the US. While technically he is authorized to work on the K-1 visa, he doesn't have proof that he is allowed to work as the K-1 plus non-work authorized I-94 are not listed as valid documents for an employer to accept, so an employer cannot legally hire him. Kind of ridiculous, I know.

So, get your fiance to the SSN office and apply for his SSN any time now; once the I-94 is within 3 weeks of expiring they won't issue him an SSN until he has an EAD, so it is better to do it sooner rather than later.

Yes, you can file for a social security number without having an EAD, but you will have to have a permanent resident card instead.

Yup, what the others said. You can only get an SSN with an EAD or GC as a K3 visa holder.

I'm answering the K1 person's question, not the K3!

There is a link on VJ to a public record memo explaining to the SSA that a K1 doesn't need and EAD to apply for a SS#, but the valid I94 will suffice. Had I not brought this memo to the office, we wouldn't have been able to apply for his #.
