confusion on actual procedure and timelines

Timeline

Greetings everyone! My name is BethAnne and my fiancé, Amine, is from Algeria. I feel like this process is just taking longer and longer. We got our approval from USCIS on January 4, 2022 (we submitted in November 2020) We waited a month and then I called NVC and got our NVC case number but have never received an email from them. What is confusing is I understood we would have to submit more information including our affidavit of support to the NVC, however, they said we don't submit anything to them but that we wait until the US embassy in Algeria requests applications and then they will ask for additional documentation. I feel like we are getting conflicting information. Can anyone tell us where we will actually send the additional information to? Also any idea what the timeline is for applications from the NVC being requested by the embassy. Its frustrating as the US Embassy web site comments that due to COVID they are experiencing significant delays, however, then it posts videos of American staff going to local events and touring the country. Any information on timelines and specifically for Algeria would be much appreciated!

you need to read K1 process here in the guides above or in USCIS site

u do not submit affidavit of support to NVC for a K1

u will send I 134 and supporting documents to the Algerian to take to interview

get familiar with the process and the steps to the interview

K-1s do not submit any documentation directly to NVC.  NVC simply holds the approved petitions for dispatch to consulates, which happens only after the consulate requests the petitions.

 

I'm not sure what specific info you are looking to provide to the consulate, but generally once they are ready to interview the applicant, they will provide a "packet 3" list of requirements.  Some documentation can be taken to the interview.

The I-129F petition was only approved two months ago.  All you can do is wait for the embassy in Algeria to let you know what the next steps are via email (see below).  Patience is the key here.  An approved petition is only the first step.  The US embassy's website for Algiers also states that they are working through a backlog of cases because of the pandemic, so there will be a delay.  It could take a long time to hear from them, but don't worry this is normal right now.  Good luck!

 

The fiancé(e) K-1 nonimmigrant visa is for the foreign-citizen fiancé(e) of a U.S. citizen. The K-1 visa permits the foreign-citizen fiancé(e) to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival. You can learn more about fiancé(e) visas on usvisas.state.gov.

  1. Once your file is received at post, an instruction package will be sent to you by email.
  2. First you need to pay the visa fee at one of Aramex offices, and then you have to register and schedule a K visa appointment through the online appointment system at

  3. Assemble the required documents that are listed on the instruction package.
  4. Schedule a medical examination with the Embassy-approved physician in Algiers at least 15 days before your visa interview
  5. Attend your visa interview. You can learn more about the interview process
  6. If the visa is issued, your passport and documents will be available in approximately 7-10 business days at Aramex office that you already selected for pick up or delivery.
  7. If the visa is refused, the Consular Officer will provide you with further information.

Some visa applications require further administrative processing, which takes additional time after the visa applicant’s interview by a consular officer. You can check the status of your visa application on ceac.state.gov. If your visa has been denied, you may find useful information on Ineligibilities and Waivers.

Be aware not all staff at the embassy process visas. I've met several workers from the US embassy and they had different job descriptions.
