Unsure.if K1 can work in my situation

Have just gotten engaged.with my fiance during her recent visit because the travel restrictions were recently lifted in her country and she has a us travel visa already from previous trips to USA.  would like to file.for the K1 visa but was told they check your income for the last 3 years. Was out of the country until the end of March in 2020  traveling and  was not working. Met my fiance in Malaysia. When returned was unable to get hired until October.  Now make about 25k  salary in 2021. Income requirements was 17420 in my state of NC. One of the visa service providers suggested that I should get a co sponsor because of not meeting the income requirements in 2020.  No one to ask for this in my family. Can I file anyway without one and have any chances of being approved.

poverty guidelines for 2022 are $18310 and to AOS after marriage 125% is 22,887

 

understand that the cost to AOS after marriage for the green card is $1225 making k1 more expensive than a spouse visa

u need to check health care insurance in your state to see the cost as it can be expensive

most of us prefer the spouse visa as it is less expensive,  the immigrant can work with spouse visa stamp on passport as soon as they enter the US (I 551 stamp till green card comes)

it is easier to get DL,   SS card,  and add to insurance, bank accounts, leases, etc

Financial support is not relevant until the I-129F is approved, which will take 7-12 months or more.  After the I-129F is approved, you will need to complete the I-134, where you will need to show that you can support your fiance.

 

You can also decide to do a spouse visa instead.  That process is less cost overall and will allow your spouse to work as soon as she enters the US.  You will need to get married first and provide evidence of a genuine relationship.  For that process, your finances will not be considered until the I-130 is approved, which will take about a year.  You can use the time to get a better job or line up a joint sponsor.
