NVC PROCESS HELP

Hi, 

I'm a U.S citizen, applying for my wife who is a foreigner and not in the U.S.

I have filed taxes jointly with her for the past two years but even though she has employment, it's an unpaid medical observership in Saudi Arabia.

I'm not using a cosponsor or her income for support in the application, however my question is if NVC sees she's employed but doesn't see her W2s or income will they send an RFE and if yes what should I be sending along with the Afiidavit of Support to avoid an RFE.

Timeline

Typically if you submit a tax return transcript then W2's are not required.  But sometimes people here on VJ reported that they wanted the W2's as well.

 

I am not sure what triggers NVC to ask for the W2 in addition to the tax transcript.  But this is not common.

 

Also, please remember that only the previous year's tax return is required.  Years 2 and 3 are optional.

Her income and tax documents  (or lack of income) are irrelevant.  YOUR current annual income is king for the I-864.  They will be checking that you properly filled in the I-864.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Someone employed abroad would not even have W2s.   And foreign income is not considered anyway.

You and Crazycat are both correct, but sometimes NVC asks for W2 forms anyway.  Safe bet is to include an extra supporting document in the form of a letter explaining the foreign spouse will have no W2 forms as her employment is unpaid and foreign.  That said, if she has no income, is she REALLY "employed"?  If it were me, I would not indicate she is employed at all but still, since the tax returns are joint, I would include the letter.

Facts are cheap...knowing how to use them is precious...
