Hi, so finally I'm able to file to remove the conditions on my gc, it's going to be a late filling due to financial hardship and health issues. I know I have to send in a letter explaining why it's so late but I would like to know what else I have or should I send with my forms also can I pay with a credit card for this? Any help is greatly appreciated.

How late are we talking about?

you should file the i751 and include evidence of your relationship from the time you entered your marriage until now. Such evidence may include: joint lease, joint bills, joint mortgage/ deed, birth certificate of children born to this relationship, trips and reservations taken together, etc etc 

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

It's been 4yrs since my 2yr gc expired

It can be done. Though expect scrutiny as your excuse may not cut it. 4 years?

Yes, I've seen posts in here of people that have waited 10yrs just because they forgot about it and been approved.

Is this a joint filing, or a divorce waiver filing?

 

If the former, then yes, you need a letter giving your reasons for filing late for it to be accepted.

If it is a divorce waiver filing, you do not need a letter, as divorce waiver filings are never considered late and can be filed at any time...

 

However, as Villanelle states, you may want to check that you are actually still a permanent resident - over those four years, you could have received a judgement in abstentia by an immigration judge issuing a final order of removal and terminating your permanent residence, which means you are no longer a permanent resident and therefore cannot file an I-751. 

 

The automated number is 1-800-898-7180 and have your A# to hand.... and they have recently updated it so you can now check the status online https://acis.eoir.justice.gov/en/

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Whether to pay by credit card is the least of your worries.

 

You may want to get a lawyer to help prepare a well-written statement about why you are so late.  I'd say your chances of approval are marginal.  Four years is a long time, and the burden is on you to show evidence that it was beyond your control.  Good luck.

Just because it worked for somebody it doesn’t necessarily mean it will work for you. Different cases, different field offices, different officers. 
That being said, it might be approvable. All you can do is try. I mean, I understand health issues, but bankruptcy? Seriously? I’m not saying it is cheap, but from the approval of your AOS you had some time to save at least some money. Come on.

Thanks, I saw your post advising someone that had a late filing also to call the number, I already did and I don't have a case open, also I'm filing jointly, no divorce.

You are right not everybody is the same, hopefully you don't see yourself in the same position I was were I had to file for bankruptcy after losing everything. Good luck.
