Hi,

  My husband and I filed an AOS in September 2021. We received a request for evidence in January asking for Form 130A as well as our marriage certificate and my birth certificate (petitioners). We had submitted all of these documents requested but who knows maybe they lost them or they got mixed up. 

I am putting together the requested documents and there are a few things that are unclear.

 

1. For Form I-130A, there is no specific list of evidence to provide for the supplemental (I-130A) form in and of itself. So when we originally submitted it, we provided all neccessary evidence for form I-130, and included I-130a with that form. I started to wonder though if we missed something and looked up if there is evidence required for I-130a. On the USCIS website it does not list anything separate from the evidence needed for I-130. But on blog sites and forums its lists pretty much the evidence needed for I-130 should also be included for I-130a. When submitting the I-130a again for the RFE should I resubmit evidence listed for the I-130? Please see attatchment for list that I found on a blog site. ( it does not have a list of evidence for the I-130a anywhere on the USCIS website. Only that the I-130a should be submitted with all required evidence with the I-130

 

2. I was pregnant when we submitted my husbands AOS, and since our child has been born. In our original AOS packet that we sent in we submitted proof of pregnancy as well as photos of me pregnant as evidence of a bonafide marriage and relationship. Since our child is now here and we have a birth certificate and social security card for him, should i submit that along with the other requested documents? Note, they did not specifically ask for this, but i just wondered if it should be sent along with the I-130a form

 

3. Last, on the Request for Evidence letter I received it says to include a copy of all the pages in the request when i send in the requested documents. But on all blog pages and forums talking about request for evidence and how to approach it, it says to include the original pages. It is pretty obvious which ones are the original and which ones are the copy because the original are printed on light pink paper and my copies are on white paper

Confused on your situation. If you filled out a timeline, it would help.

 

  1. Your profile says K1 visa. Filing for Adjustment of Status would make sense for a K1 after entry to the US and marriage.
  2. You posted in the IR1/CR1 forum which has nothing to do with a K1 or AOS.
  3. If #1 is true, K1 visa/AOS, why do you have an I-130 or I130a?

Good points.  Answer to your question 3.  Only reason to do that is if the marriage took place more than 90 days after the K1 entry.  Kingpups needs to explain and actually ask a question.

My husband and I forfeited our k1 visa after not hearing anything for 1 1/2 years. We got married here in the US and have filed for AOS. We received a request for evidence for forms and documents that we had submitted in the original AOS packet. My questions are regarding if there is any additional evidence for the I-130a form specifically, seperate from the evidence that you include with the I-130. Should I resubmit the evidence that we had included with the I-130? As well as my questions above regarding our sons birth certificate and the RFE form

If it was me, I would start over. I would send a new I-130 (Add child’s name on page 6),  an I-130a, and all the evidence again plus the child info. Send pink form. Keep a photocopy of it for your records. Make sure the marriage certificate is certified by the county clerk as an exact copy of the one on file in county marriage records. USCIS is somewhat vague on the I-130a. This page may help https://self-lawyer.com/form-i-130a-how-to-fill-out/#Form_I-130A_Checklist which is basically the list you posted.

Do I submit the original Request for Evidence forms (pink color pages) when responding to an RFE? In my RFE that i received, it says to "Please include a copy of ALL pages of this letter with your response". But everywhere that i see online says to include the original forms and make a copy to keep in your records.

Definitely make a copy. Send one back with the RFE, whether original or copy. But the most important, make a copy!!

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Yes, thank you. I will definitely make a copy either way, but do you know what forms to send in with your reply (the original pink forms that were sent to me, or a photocopy?)

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)
