Hello Everyone,

 

I just received my notice to appear for Interview yesterday and is scheduled on March 31, 2022.

 

My mom was recently diagnosed with Stage 3 cancer, and I have planned to take a trip to the homeland  to provide support on her chemo. I had also applied for FMLA so i could stay out of work longer than my PTO allows. My FMLA is already approved

 

My trip will be on April 21 to May 29. 

 

I am confused whether I should take the interview or call to reschedule or just go and request my oath taking after my trip (if this is even possible) as I heard oath taking can be same day if approved on the spot.

 


It's a bit complicated to change my FMLA as well.  As much as I really want this interview, my mom's life and chemo journey is also very important to me.

I even attempted to write to the officers regarding my trip and uploaded it to the website stating that  if they are ready to schedule me, if they could do it after June 1 and provided them my travel dates (It was a long shot but worth a try)

 

 

Any thoughts? Not sure which is the best route:

 

1) Take the interview, see if I am eligible for same day Oath and apply for expedited passport

2) Take the interview, request to schedule oath after my return if i cannot do it same day (if this is even possible)

3) Call now to reschedule

I’m sorry to hear about your mum and hope everything goes well for her and the the Family.
 

This is all personal choice as opposed to anything else. Me, I concern myself with what I can control and don’t worry about what I can’t. So looking at your timeline: congratulations on your interview btw. I would go to interview on the said date (you never know when the next one will come up) - this is what I can control and explain the circumstance (bringing with me any backup), ask if they could do same day oath and if they can’t request for one post trip. If they do same day oath, and offer it to you, I’d do it. This gives you 3-4 weeks to get a passport or you can follow Timona’s advice

I forgot to mention that in my application, I included a request for name change to make a correction on my MIDDLE name only. This does not affect my airline tickets as I only booked using my first name and last name.


With the name change, does this automatically prevent me from doing same day oath you think? I am reading on older posts that applicants with name change requests, oath taking must be done in a courthouse not in a USCIS office. If this has not changed, then likely i won't be same day.

If name change that’s judicial and needs court paperwork - definitely not a same day oath (unless you drop name change request).

I actually don't mind taking my oath ceremony after my trip, considering how long it takes to apply for a new passport :( My interview is March 31 and flight is April 21 :(  Too close and no guarantee I can expedite my passport.

 

I am dual canadian so I'm not sure how I can go back inside USA without a greencard even if I drop my name change and take same day oath.


Would it be ok to tell the officer to delay an Oath and explain the situation?

Well special issuance agencies are working and one can get a passport in 2-3 days with proof of travel within next two weeks. 
 

But yes, you can definitely raise the issue with the officer to schedule you for later. With judicial ones they may have a schedule available to let them know when the local court is doing those ahead of time.

i am sorry for you mom and i really hope you get good new soon. as far as interview i think you should go to interview and hope or ask for same day oath ceromony i have hear it is possible.

 

also i'm very curious how you n400 took so short(6 months).

did you have a pending i751?

I already checked that. The agencies that could get expedite passports for 2 to 3 days before now offers 15 days expedited in Orlando Area.  I remember my husband paid $500 next day service in 2014. This same agency charges $800 for 15 days now. 

 

I will definitely ask.   I looked around for Naturalization for courts, nothing in Miami area and west palm beach. Also, all other locations like Orlando,  fort myers don't have a schedule except for Tampa. Would you know where I could get this info? Google doesn't provide much info surprisingly

Hello, 

I have no idea. I was very confident to book my trip and apply for FMLA because online it says 11 months of wait. Was surprised today that I got a notice for an update on my case.

 

I do not have a pending I751. When I applied for I485, I was married to my husband for more than 2 years already, so i got 10 year GC right away.

You should be fine. Don't change your flight. Most oaths occur within 3 weeks.

 

As soon as you get oath date, follow the guidelines above to get PP issued within 72 hours. I did it @shakeyy

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

As mentioned above name changes require judicial ceremonies and wouldn't be offered same day. Your middle name correction is it something USCIS messed up on or was it messed up on your BC? you may not need to do a name change if it was them that messed it up.
