Adjustment of status question [merged threads]

Hey everybody, I recently came to the US on a K1 visa and got married about 2 weeks ago. I’m getting ready to start the whole AOS process but I was wondering, I’m confused on whether I need to do a whole medical again since there are confusing steps online. I already did one before I got my visa as you have to on a K1 but I don’t understand why some people are saying you have to have another medical after you arrive, get married & before you apply for your adjustment of status. Also, I opted for getting my vaccines done in the US instead, does that also affect anything? If someone could tell me what actually happens, I’d be grateful.

Practical advice:

 

If money is no object get another medical.  Otherwise as the rules for when a medical is needed are somewhat arcane, you can defer the medical  and let USCIS determine if you need a medical. If it does, you will get a deficiency notice (meaning you will likely have an interview) or an RFE (meaning there is a good chance you will have interview waived).

 

If you get the RFE and the interview is waived, then not sending a fresh medical means you will have delayed getting a green card.  
 

Most of time, the K-1 medical doesn’t age out and there is no need to get a medical.  
 

We did do a medical in the USA and took care of vaccine deficiencies at the doctor who did the medical in the USA.  Our IO was angry that we did a medical but he didn’t RFE us for vaccines either. We were approved less than 2 weeks after interview.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I think powerpuff answered it see below - it has to be civil surgeon approved by the USCIS.

Well, that was a mistake. Your medical is not complete. You will need to find a USCIS designated civil surgeon to complete your medical. Some of them agree to just do the vaccine part at a reduced rate but other will require a full medical. If they don’t agree to transcribe the vaccine part only, you don’t really have a choice and will need to pay for a full exam.

Thank you, I already found out through the uscis website that I don’t actually have to complete the full medical, I just need to go to an approved surgeon and get my vaccinations done and get them to fill out the medical form for vaccinations to say I have completed it.

I wasn’t aware that you weren’t allowed to ask related questions, the post before was me asking different questions about the medical. I thought I needed to start a new topic to ask another question about actually filling the I-693 form when all I have to do is take the vaccines.

You can take it up with the moderators if you don’t agree with that.
