Who Pays the Fee

We strongly encourage you to pay the USCIS Immigrant Fee after you pick up your immigrant visa from the Department of State and before you depart for the United States.

 

If you cannot pay the USCIS Immigrant Fee, a family member, friend, employer, attorney, or accredited representative can pay for you. If someone pays the fee for you, they will need your Alien Number (A-Number) and Department of State (DOS) Case ID.

 

You may also pay the fee after you arrive in the United States. If you choose this option, we will send you a notice requesting payment with instructions on paying your fee. You will not receive your Green Card until you have paid the USCIS Immigrant Fee.

The lawyer is wrong.  However, be aware that a green card will not be produced until the $220 fee has been paid AND the new immigrant has entered the US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Not sure why but after immigrating you can only pay once they send you the payment notice. Expect decent delays in that case to get the GC. Best is to pay online before immigrating.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Why delay?  Paying it before entering the US will avoid delay.  It should not influence the SS card as that is produced by the Social Security Administration.

I m not trying to delay it voluntarily but since yesterday I went to USCIS website,  I entered the Alien number and case id from the visa and it's not letting me pay. It says to wait 5 business day if I just received the visa. Flight is next week.

I hope you used the correct case ID while paying by not including the last two digits on your IV case number.

 

Anyway, i'd say have your petitioner keep trying till you land.

No impact to SSN issuance.  I got my SSN card around a week after POE, even if I paid the immigrant fee only after US entry.

You need an I-551 to get a social security card.  
 

After you enter the USA, your stamped immigration visa is an alternate I-551.  So you can use your passport with the visa to get a social security card.
