I-134 help please

Hi everyone,

 

So we're filling out this I-134 form (Affidavit of Support) and we've come across a few questions which we need some help with please. I know some of these questions are no brainers but we just want to make sure we file it correctly haha

 

1. PART 1, 11d (my fiancé was born in the USA) we ticked this box (no A-number)?

2. PART 3, Income and Asset information - ''My annual income is'', so shall we put down her current W2 income in this box as she's not contracted hours, earns however many hours she works etc? 

3. PART 3, 10a - She has children, however only 1 lives with her and she claims only 1 on her tax return. Do we only put this child or her other children too? (they're under 16)

4. PART 3, 26a - ''I have submitted a visa application etc'' - So this would be the beneficiaries details?

5. PART 3, 38 - Shall we not tick any boxes and write next to it - N/A (K1 Visa Process For Permanent Residence)

Nothing hear as the USC sponsor is a citizen by birth.  See the instructions at the top of the section.

Yes, only list dependents, so if she does support her other children even if only partially, they should be listed.

Yes, the person applying for the K1.

Put whatever number you can prove on paper. Just don’t put something higher without proof to back it up.

Hey, thank you so much for taking the time to help me!

 

I am wondering what partially would mean? They live with their dad full time and he claims them on his tax return. My fiancé doesn’t clai, them on her tax return so I guess they wouldn’t be dependent on her? Haha this is so confusing

Hiii, so her current W2 says let’s say for example 50k, I’ll put 50k on the form and once they see it corresponding with the W2 then they won’t really ask for anything else hopefully haha (I’ll have her tax return or transcript together with the W2).

The I-134 form on the NVC website expires on 02/28/2021, isn’t this now invalid? Or can I still use this form for 2022? Thank you :)

I expect "partially" would mean providing child support or other financial support even if they are not claimed as a dependent on a tax form.

This is the latest form available from USCIS, so you are fine using it.

This is the latest form available from USCIS, so you are fine using it.

Yes, the W2 can be the proof of income you turn in with the I-134. That would suffice for a London K1 interview. If you are also providing a 2021 tax return, then you can use the “total income” line on Form 1040. (Line 9).

Forms don’t actually expire. The date on the top right shows when it must be reviewed —

OMB No. 1615-0014

Expires 2/28/2021


That is the Office of Management and Budget form number. They have a number for all government forms and review all forms every 2 years. Their date for review deadline was 2/28/2021. They will publish a review period where the public or agencies can make comments. Then they make changes or keep it the same based on their review.  Eventually the form will get a new OMB date showing when it’s next review happens.  You are always safe using the form posted on the USCIS website.

This was super helpful, this whole process was so daunting but I couldn't have done any of it without the help of you amazing people! :)

 

Just one last question: once I-134 is filled  out, printed and signed can my fiance scan the copies to me to print or does she have to physically send the 'wet signature' as they say lol

London has accepted scanned copies for others. His printer paper will be smaller (A4 instead of 8.5x11) so he’ll have to work that out.  Or you still have time to mail it snail mail to the UK. I wouldn’t pay for Fed-Ex or fancy handling…just a postage stamp. If it doesn’t arrive, you still have the scanned copy plan. The I-134 is all you need to provide for his interview. The rest is his personal documents for the medical and the interview.
