My two stepdaughters, ages 14 and 18 yrs old, recently immigrated from Mexico. The 18 year old received her social security card and evidence that she is a legal permanent resident; however, my 14 year old has not received a social security card or Certificate of Citizenship. Should I expect to receive those in the mail or do I need to apply go these?

Is your spouse a US citizen?

Did you check yes for an SSN on the DS-260?

If the 14 years old has a USC parent, lives with that parent, and being admitted as an LPR is automatically a US citizen.  She would have to file the N-600 for a Certificate of Citizenship and it will cost about $1000.  A CoC is not sent automatically,

Yikes! More money? I am a US Citizen and I filed for both of them together 3 years ago so I think since my older girl received her card my 14 year old should be getting hers too…hopefully

Your stepdaughters can not derive US citizenship from you since a stepparent can not pass US citizenship to a stepchild.  You can't pass US citizenship on to them unless you legally adopt them before age 18.

You filed I-130s for them in the IR2 category as their stepparent.

Is their biological parent who is your spouse a US citizen?

No. He is a Mexican citizen. We are in the process right now of filing citizenship for him. Another thought— can we file for a US passport for her at this time?

No.  She is not a US citizen.  She can not get a US passport.

Since your spouse, the biological father, is not a US citizen, he can not pass what he does not have on to his 14 years old daughter.  Once he naturalizes and she is still under 18, then she automatically becomes a US citizen.  At that time, she can apply for the N-600 Certificate of Citizenship and/or her US passport.

Your stepdaughter got here a few weeks ago.  Give it a few months before contacting SSA about not getting a card.

I can’t begin to thank you and other members that have provided such great information and advise. It would have been difficult to do this without hiring an attorney without you guys!!
