So just an update on my end -- I received an RFE notice today through the Lawfully app. I still haven't received the actual physical document with instructions by mail. Should I be concerned? I'm just wondering what they are going to want on our end.

I'm wondering the same.  I also received my expedite approval last week, and today got notified they mailed me an RFE.  Not sure what they will want as I preloaded our application with more than what they need back last June.

It’s usually something real dumb and small. For me, my RFE was for my birth certificate. I had sent a certified copy but not a long copy. It wasn’t good enough. I didn’t realize I had sent in something that wasn’t certified enough.

Somebody who is anti Putin, has taken part in anti war protests etc would have a good claim for asylum. B is a non immigrant visa.

Well, our friend has his jail records and court paperwork. If he applies for asylum, that will absolutely help his case. For sure. I don’t think he will apply for asylum though. Asylum means you can never return. Most Russians will want to return because of family.

Congrats to everyone who has already received their approval! for @Griff7 -- so I received my RFE mail and I know what I have to provide now. I had a couple dumb misdemeanor tickets from back in college (like 6-8 years ago) and they just want me to share certified court reports. I was more worried initially that my fiancé would have to provide further documentation, but since the RFE is for me I'm way more relieved. I did my own research on visajourney and have seen others have done WAY worse things in their past and gotten approvals, so I'm not worried. Now just waiting for those court reports in the mail and will forward them to USCIS, so hoping to get the NOA2 in the next couple weeks 🤞

Today received "On March 31, 2022, we mailed a request for initial and additional evidence for your Form I-129F". Completely destroyed any hopes to get k1 anytime soon. We are monitoring tickets to Mexico for next week and just going to try get a humanitarian parole on the border. Insanity to be honest, why can't the US do the same as Canada with electronic visas...

I honestly would not give up that easily. Your case has already been expedited if you are getting married to a Ukrainian citizen. I'm going through the same process and hope to have my RFE information mailed in to them next week. If your case is already being expedited they should take your RFE as top priority over others that are going through the same process.

My fiance and I have been waiting on a K-1 answer since July. She has fled from Ukraine to the Netherlands and we tried to expedite her visa with paperwork and with our congressperson but have heard nothing. We wonder if there is any other reasonable avenue we should take (refugee, probation, Mexican border, etc) or is it more prudent to wait out the K1 process?

Any help is greatly appreciated.

Have you tried to call USCIS and put in a request? That’s how I got my expedite granted. You have to wait on hold for like 45 min but obviously it’s worth the time. July 2021 filer here also.

There are no refugee visas. I'm not sure what you mean by probation? I've not heard of this option.

Mexican border: if you chose this option, it is wise to do so before May 23rd. That is when Title 42 ends. Once Tile 42 is lifted, Ukrainians will have to get in line with the thousands of other nationalities waiting to claim asylum at the border. The situation is bound to get very chaotic there once that is lifted.

In that case, I think filing for the expedite makes the most sense. Many people here have had luck with it.

Another option is to abandon the K-1 and do the CR-1 via DCF. Go meet her in the Netherlands, get married (actually the marriage can take place anywhere) and then try to file for DCF at the local embassy. This would probably be the fastest of all options actually. The USC just needs to be in a foreign country in order to qualify.

When you spoke with them did you file a request for expedite? You should let them know others with Ukrainian fiancés have gotten their expedite requests granted. They should file the request for you and give you a receipt number.

Hey guys,

Would really appreciate your advice...

My fiancé just received NOA2, after just 2 months of wait

But due to the war I had to leave Ukraine and I'm here now in the US on my B1/B2.

Does anyone know if I can have an interview and further proceed here? Without going to Germany or any other US Embassy in Europe

Thank you in advance!
