Reentry permit 2022

Hello guys, I did not find a lot of information about Reentry Permits online so I'd like to see if you guys can give me some help.

Reentry permits are for those GC holder who need to stay abroad for 1 year or more. Im gonna be studying in France for 2 years.

 

I left the US in January 2022 and I ll be returning in MAY 2022 for 2 weeks. Then I go back to France.

I am gonna return to the US, five months later ( October 2022), to stay 1 or 2 months. Then I go to France again.

 

My questions are:

 

1- Should I apply for the reentry permit in MAY or I should be fine if I do it in OCTOBER? 

 

2- I read online that the Reentry Permit can be denied if I leave the US before USCIS ˜receives" my package. I saw some people having problems with that...Im not talking about the Biometrics appointment... ( https://www.***removed***/forum/after-getting-usa-green-card/738698-re-entry-permit-denied-what-are-the-chances-with-appeal ) . do you know how accurate is that? Or can I just file and leave ( thats the reason I dont wanna do it in May )

 

If its ok for me to do in October I would prefer! what do you guys recommend?

Without a reentry permit, your travel could possibly be interpreted,  by the CBP at entry, as having abandoned your PR status by living overseas and “visiting “ the US.   The reentry permit is strong evidence that your trips are not abandoning your residency   You can leave the US once biometrics are taken .. or you are notified that they are reusing previous biometrics.  Its possible  that this wont happen in the 2 months after submission .. there is no guarantee …    but that stay in the US would seem the best time to apply .. hopefully your 2 trips will not raise any questions   Keeping as strong ties as possible to the US will help if questioned .. study course of limited time , drivers licence, bank accounts etc ,   Its too late now for the “best” option …. which was to get the reentry permit before you left the first time.

The link you provided said the permit was denied because the LPR left the USA before the application was received which is an interesting data point.  
 

Anyway since you plan to spend more of your time outside the USA than in for the next 1-2 years, I think you should apply for the re-entry permit.

It looks like you are already in France and will return in May?

 

Apply in May.  Per the link you provided, you should stay in the US until USCIS receives your form.  I am not sure how you will handle the biometrics if they schedule one.

thank you, you mean the second stay ( october ).?

 

Yes, I have strong ties in the US, I have been planning this exchange program overseas for a while,But I was supposed to start in March but then I received a last minute call to go to France ( I had lliterally 4 days to flight to  Paris .. I did not have time to apply for the reentry :(

Yes. October but you will need to consider what happens  if your biometrics isn't done by the time you planned to return
