First thing would be to see an attorney. But I think you are going to need some damn good grounds to find one willing to sue the government.

Not to be nosey, but what ARE your grounds to sue?

Aug. 2001 - met online playing trivia

May 2006 - engaged

06-12-06 - Met with lawyer, filed for a K-1 visa

07-17-06 - NOA1

10-31-06 - Touched

01-29-07 - Found out from USCIS that my lawyer had filed at the wrong service center and nothing has been processed.

02-08-07 - Found out that our petition had been closed back in Oct. 2006. No one was ever notified of this from USCIS

02-09-07 - Began gathering paperwork once again to start all over. Started cancelling our wedding plans

02-20-07 - Filed for a K-1 visa once again

02-27-07 - NOA1

04-21-07 - Originally planned wedding date (had to cancel) :(

05-22-07 - Touched

06-01-07 - Granted a Congressional Inquiry!

06-15-07 - NVC received our approved I-129F petition (I never received an NOA2 via email or snail mail). We are just so HAPPY to finally move on!

06-25-07 - Packet 3 received (but it was rec'd by our lawyer, she has forwarded it on to my fiance in Australia)

06-28-07 - Fiance rec'd Packet 3

06-30-07 - Finally rec'd NOA2 via snail mail. It is dated June 25, same day as Packet 3 was rec'd.

07-05-07 - Mailed back form letter DSL-1076 (Applicant's Statement of Readiness to be Interviewed).

07-05-07 - Just waiting now in hopes of an interview date before APEC

07-13-07 - Received Packet 4

07-30-07 - Interview!!!! - APPROVED!

09-01-07 - Fiance arrives in the USA!

10-06-07 - Getting Married

or what you guys think about sueing uscis concerning case i-130

Personally, I think it would be a huge waste of time to even try. But it is very difficult to even ask for our opinion when we know so little details. sorry

Why dont you take a step back and contact your congressman's office for some assistance so you can find out exactly what the delay is?

Cander, you can sue anybody, including the US government, and you will surely find an attorney willing to do it. But, will you actually win anything of value by filing suit? That is the question. You probably won't win, and if you did, would you be awarded an immigration benefit for your spouse? or just some monetary compensation for the hardship caused by them not giving you timely info? You probably won't win an immigration benefit in a civil suit. Contact your congressman or senator, and find out what the delay is. have you called USCIS and inquired repeatedly as you are way over the normal processing times?

Also, fill in your timeline.

03/12/2007 - Married to my beautiful wife

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

BTW, why did you wait until 2007 to follow up on your case? 2 years is a long time for them to hold off a case without giving you any reason why... or did they?

USCIS is a govt agency...they are immune from lawsuits. You can sue with the permission of the US Attorney in some cases, like you were injured by a mail truck, or the govt breached a contract and you suffered liquidated damages.

You can only obtain a writ of Mandamus, which forces a govt agency to do their job.

Have you suffered monetary damnages, or a personal injury??

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
