CEAC - All documents accepted, but received message to submit evidence of income (already done) - what to do?

August 28, 2021 - received RFE on November 16, 2021 for joint sponsor regarding a missing 1099 form. Uploaded shortly after request.

February 26, 2022 - Received three RFEs - will explain in more detail below.

 

On the CEAC website, all of my files now say 'accepted'. Still, I received three RFEs. The first two say,  “please submit petitioner’s evidence of income”. I have already submitted all of my documentation and my joint sponsor's documentation as it pertains to evidence of income. In addition, the third message simply said "“This case does not meet the minimum income requirement to sponsor the intending immigrant. To avoid delays, an additional affidavit of support from a joint sponsor may be submitted. The consular officer will make a decision regarding this requirement at the time of the interview.”

 

I have not received any message saying I am DQ'ed, despite all documents being accepted. I've read about similar issues on this forum, but none are especially clear. Does anyone have any suggestions on what to do in this case? I have no problem submitting the documents on CEAC, but will this delay the processing of my case? Or could I just bring evidence of an additional joint sponsor to a consular interview?

You can ignore the "does not meet" part.  You already have a joint sponsor and the Consular Officer will make the decision.

 

What "evidence of income" did you submit.  Tax returns are about the past.  Current pay stubs are "evidence of income".

Facts are cheap...knowing how to use them is precious...

Hi, both my joint sponsor and I submitted evidence of assets. So, I uploaded bank account records and the joint sponsor uploaded deeds from the homes they own. Since my income is foreign, it will not be considered by the CO - and my joint sponsor is retired and does not have a W2.

Generally the 3rd message results in DQ. 

 

You might have to call NVC to rectify the issue. 

Will try calling them and will report back on what they say!

Good luck and please report back. 

This is an issue we are trying to avoid at NVC stage. 

If you didn't submit a signed statement indicating no W2s or 1099s were available they still request it/request proof of income for some reason. 

Hopefully you can circumvent another 3 month wait with a phone call.

If the assets are properly documented, that will carry the day, but even retired people have evidence of retirement income if they have any kind of pension or Social Security.  A "W2" is not evidence of current income.  A declaration of benefit from a pension or Social Security is.  If your joint sponsor is a self employed "landlord" then their current income is the line labeled "total income" on their most recent tax return.  Note that a majority of "landlords" have a negative "total income" on their tax returns.

Hi, I called and they told me that I would have to submit a statement explaining the absence of W2s - as you mentioned. She also said that we would go to the back of the line...

Yes, that appears to the be problem - so we will resubmit the forms as they have requested. However, now the problem is that both sponsors are marked as 'accepted' in CEAC - therefore, I cannot upload any documents as the option has been removed. Not sure what to do other than call them back and explain the issue. Still wish that they would allow me to visit embassy to explain issue, as they've already agreed to expedite the case.

sometimes you get lucky and it doesn't take that long.

they asked me for a doc that was already part of my original filing, they checked it the very next day, but it is correct for them to say you would go to the back of the line.
