Ukraine IR-1: where to transfer?

Timeline

I just paid the fees at NVC.

Kyiv embassy tells us to transfer our petition to another embassy.

Jenny has visa free travel to Europe, much of the Middle East and much of the Caribbean

Any thoughts on the best embassy to transfer the petition to?

it is Lviv unless NVC transfers it out of the country (like they did for Russia to Poland)

but embassies other than those , she would need to have approved residency

The embassy Web site is a little confusing.

On Sunday, February 13, 2022, the Department of State suspended consular services to include interview waiver services at the U.S. Embassy in Kyiv. Applicants for U.S. nonimmigrant visas may apply in any country in which they are physically present and where there are appointments available. As each U.S. Embassy has specific application procedures, you should contact the U.S. Embassy or Consulate where you wish to apply directly.  Contact information for U.S. Embassies and Consulates is available at www.travel.state.gov.

If you have an immigrant visa case currently pending with U.S. Embassy Kyiv and would like to transfer processing of an immigration case to another U.S. Embassy, you must contact the receiving U.S Embassy in that country to authorize and initiate transfer.  The Embassy will have a list of requirements which must be satisfied in order to begin the transfer process.

Our immigrant visa case is just starting the NVC process.

Found this on state.gov. Now I am thoroughly confused.

  • If your petition is being processed at the National Visa Center (NVC), contact the NVC to request the transfer.  NVC will transfer cases to another IV processing post if parties provide a written request along with the address in the requested country and the proof of eligibility (citizenship/legal residency in the requested country or other documentation). This can be provided at https://nvc.state.gov/inquiry. 

Apparently NVC transferred the Russian applications to Poland. I will proceed as if Ukraine is still processing immigrant visa's until State tells me different.

This is the problem.  Legal residency is usually required in the country the case file is transferred to.

With the situation in Russia and Ukraine, I don't think residency will be required else every Russian petition sent to Poland would be denied.

From the info above, I see that there are 2 different paths to follow.

1.)  Request transfer to embassy of choice at NVC

2.)  Contact embassy of choice and ask if they will accept the petition.

 

I would start with #2.

The residency requirement is not applicable in situations like this, where the State Department has told applicants they can apply anywhere for a non-immigrant visa and to contact whatever Embassy the want to initiate a transfer of an immigrant visa case.  They will not be processing visas out of Lviv at all.

Which goes back to the original question. Is there a best or good embassy to which I should request the transfer?

I received this response from the embassy in Warsaw today. Waiting to hear back about I-129F. 
 

If you are a U.S. citizen with a Ukrainian spouse or child seeking to travel to the United States on an immigrant visa: 
If you have already filed a petition with United States Citizenship and Immigration Services (USCIS) that was not yet approved, you may request emergency local filing of a new I-130 petition in Warsaw (provided you also send a petition withdrawal/cancellation letter to the USCIS) by sending an email to support-poland@ustraveldocs.com. 

If you have an I-130 petition approved by USCIS pending processing at the National Visa Center and want to transfer it to U.S. Embassy Warsaw, you may request expedition and transfer from the National Visa Center: Public Inquiry Form. 

If you have not yet filed a petition but wish to do so at U.S. Embassy Warsaw, you may email support-poland@ustraveldocs.com to inquire regarding possible local filing.

This is the official response from my inquiry to Kyiv IV: (short story - Warsaw)

U.S. Embassies in neighboring countries can accept visa applications from Ukrainians. Please find a list of Embassy websites here: https://www.usembassy.gov . Interested applicants should follow instructions on the respective Embassy website to apply for a visa. Embassy Warsaw seems to be the most responsive to applicants at this time.
