Hello,

 

I have  a question regarding my attorney please. We were approved about 3 weeks ago and we have to start the NVC process.  I paid the attorney for filing the petition and when we received the approval I paid them to do the NVC papers and sent my attorney all required documents to submit but they said my case was assigned to the attorney to work on it and will submit the documents in the order it was received! 

 

Is this right?

Filed: Citizen (apr) Country: Morocco
Timeline

the order to do NVC is 

1.  get the assigned case # for your embassy

2.  get the 2 invoices for AOS and DS 260

3.  pay them

4.  when NVC says they are paid , the attorney can fill out the I 864 with your supporting evidence

5.  and fill out the ds260   with the information supplied by beneficary

u should familiarize yourself with the process from the guides above so u know what is going on

and ask attorney  questions

this is the official webpage for the NVC process.. a vert thorough and step by step guide .. dont let the attorney tell you things that just aren't correct .. stay on top of it yourself ..

I received the case and the invoice numbers; paid the fees and send the documents to the attorney to upload but the attorney said they can't upload them soon; they will work on it in the order it was received from me.

Thanks for sharing the link. I already have an attorney and I thought he should the job because I paid him and he said he is going to finish the process, but asked me to wait for my turn and he didn't tell me until when do I have to wait. Is what the attorney doing right? Especially he already received his fees?

Doesn't sound like great customer service.

Unless your contract with him has a clause regarding timely action or response, I think you are stuck.  Perhaps you can report him to the state bar if he keeps being unresponsive, but I am not sure there is much you can do.

That's typical, your attorney is attorney to lots of people not just you so they will process accordingly. Depending upon the service, it could be few days to fee weeks.

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-07: AOS and IV Package mailed

It has nothing at all to do with NVC.  It is between you and your attorney, and entirely about his own work process.

That is your attorney's particular process/preference.  Nothing at all to do with NVC.

The problem with using any 3 rd party service is that you are not their only client. They cant drop everyone else to attend to your application. They add it to their pile and work through the pile in the order they choose

I will start by saying there is nothing wrong with using an attorney to file the paperwork but this is one case where you would have completed it faster.

 

You are now 3 weeks and counting behind.

 

At the very least familiarize yourself with the forms and list of documents that have to be uploaded. It is very straightforward.
