Case Transfer Concerns (merged)

Hello there. I need your candid opinion on this please.

I' m a Nigerian and got married to a US citizen but I'm currently in Ukraine and due to the unrest and uncertainty of war with Russia, all US consular services in Ukraine have been shot down. I have until August as a legal resident in Ukraine and our Cr1 (Marriage visa) is at the NVC level, meaning that, getting an interview date is the next thing. My questions are:

1. Do you think transferring my case to the US Embassy in Nigeria is a great option considering how overwhelming the backlog is over there?

2. Do you think remaining in Ukraine makes any sense as to not knowing when consular services would resume?

3. Do you think transferring my case to an African country where US consular services are faster is a great deal? If yes, please advise on which African country.

I really hope I get a helpful response and please I'll highly appreciate your suggestions. Thanks!

Unless there is an actual automatic transfer -like Venezuelans being interviewed in Colombia or Russians in Poland- in order to get an interview for an immigrant visa you must be a citizen or resident of the country where the embassy/consulate is located. 

 

That limits your options of getting the case transferred.

Email the US embassy in nearby EU countries and ask. It doesn't hurt to try. Be sure to highlight your valid student visa and /or whatever visa you have in the email and highlight the closing of the embassy and possible war. Ask you spouse to do the same! Someone will respond back.

10/28/22 : I-130 petition sent to consulate

10/31/22 : Consulate received I-130 petition

11/16/22 : I-130 petition approved. Packet 3 received

11/18/22 : Packet 3 sent via email

11/21/22 : Packet 3 accepted / Request for interview Approved

11/22/22: Interview scheduled for Dec. 

12/12/22: Medical completed

12/27/22: Visa Interview / 221g issued

1/18/23: Consulate received requested document

1/25/23: CAEC status changed from refuse to issued

1/27/23: Passport picked up

2/5/23: Paid immigration fee (OS155A)

6/7/23: Arrived in U.S.A

6/20/23: SS card delivered via USPS

7/20/23: GC being Produced

7/25/23: GC mailed

7/28/23: GC delivered via USPS

Thank you for your response. Does this mean I can't use an ordinary visa for the interview in another African country? And do you think there would be an automatic transfer in the future for Ukraine since they're in the same pod with Russia?

Probably there will be an alternative for Ukraine citizens/residents to process immigrant visas, but in your case that should happen before your residence expires.

 

Regarding other African countries, you could check by embassy to see if they accept non-residents for immigrant interviews -normally that should appear on their websites-.

  • when u say "at the NVC level"  what part of the process there is done?
  • have u submitted the criminal report from Ukraine?
  • Are u dq"d?
  • what are your plans?  stay or go home?  Morocco is pulling its students out so is Nigeria saying to leave?

u need the criminal report from Ukraine and Nigeria both for the interview

Thank you. The only thing left at the Nvc is to submit our documents. I and my spouse have all the required documents ready and would be submitted next week. My question hits on knowing whether it's advisable to transfer our case to Nigeria or not. I'll like to know if you have any idea how long it takes to get an interview date in Nigeria currently.

Hi fam. I'm enquiring if it's advisable to transfer our Cr-1 visa to the Lagos consulate considering the fact that US consular services have been closed down where I'm currently living. Please does anyone have any useful information as to how fast/slow Lagos embassy processes immigrant visas at the moment? Thanks!

u must decide as this is a personal decision but with so many other embassies picking up the slack for Russia and now maybe Ukraine ,  i will give u just a personal opinion

i am not there and since none of us in the USA can  see the situation first hand ,  i and others can only give u an opinion

 

i would take my personal papers and belongings and leave Ukraine and return Home to Nigeria where you would probably have a better  chance for your interview quicker than a foreign embassy 

 

like i said "personal opinion"

Since you will no longer be a legal resident of Ukraine by the time your interview is scheduled, Poland or wherever they send Ukrainians to interview would not be available to you.  You will then have one choice, your country of citizenship.  Don't expect exceptions to be made for you.  You can ask, but do not "expect" or even get your hopes up.

Thanks for your response. Though, I'll have an option to renew my residency in Ukraine. The uncertainty behind when consular services would resume is my concern. Do you think they'd automatically transfer my case from Ukraine when it's time?
