I am not sure about K-1 or CR-1. I am not married right now. Is there advantages to doing the CR-1? Is it faster? Thanks again for your prompt responses

  • CR-1: 2 year conditional permanent residency on arrival (married < 2 years)
  • IR-1: 10 year permanent residency on arrival (married >= 2 years)
  • K-1: finacé visa for unmarried persons. One must marry in US after arriving on this visa and then begin green card application process.

The K-1 visa is roughly double the work end-to-end. The CR-1 visa is for applicants already married to a US citizen and the marriage is less than 2 years old. The CR-1 gives the foreign spouse a conditional green card, SSN, travel authorization, and work authorization on arrival. The CR-1 visa process takes 3-6 months more than a K-1 visa. However, there is little bureaucracy after the visa is approved. If the visa takes 2 years to approve, it can be converted to IR-1 on first arrival, which gives the spouse a 10 year green card.

 

When a K-1 visa holder arrives, they cannot work for 6-12 months while they wait for their EAD card. They also cannot leave the US until they receive an AP card. This can become very boring and frustrating for the non-US spouse.

 

I wish I went with a CR-1, but my options were more limited at the time. It was the beginning of the pandemic. The borders were closed so I could not visit my fiancé in person to marry. Thus, we went with the K-1. Now, that we are approved, we are beginning bureaucracy part II in the US.

K-1 - Your fiance comes across and you adjust status.  Fiance cannot work until work authorization is issued, Fiance cannot travel outside the US until travel documents are authorized.  Fiance is 100% dependent on you for probably the first 8-9mo. 

CR-1 - Partner comes across as a spouse, but is able to work and travel freely as soon as they arrive.  You still have to remove conditions, but that's not such a big deal.  

 

Once upon a time, a K-1 got your fiance to the US a lot faster, but in these covid times, the waits are approximately the same.  Coming on a CR-1. the spouse comes on equal footing, able to work, travel and really begin a life.  No stress of imprisonment in a new country. Just the usual relationship stress of learning how to be with one another.

This is if you met your fiance on an online marriage broker site, or what could be mistaken as a marriage broker site.  Those sites have to follow certain IMBRA guidelines on how they charge for services, needing to perform background checks on the USC client, and what they disclose to the foreign client.

 

If you meet in Tinder, Facebook, Twitch, CutePandasDoingLightsaberTricksWithSticks.com, etc...you do not need to include the website's TOS.
