Hello. 

I have been in Kyiv Ukraine since November for the birth of our son.   We have a received date of May 12 2021 on our K1 visa.   We were planning on waiting here for appointment and all going back to US together.   Now with the Russian situation and the embassy closed really puts is in a bad situation.

   The embassy in Poland says they can issue us a emergency tourist visa for my "spouse".   So we would have to get married and forget the K1.  Since she is not working and we have a child together.  Do we have good hopes of obtaining this emergency tourist visa?  Or are we going backwards by ditching the K1?

I'm guessing the advice they gave you was generic in terms of what they can issue now, irregardless of the petition you currently have in place.  As for whether you will get the tourist visa, no harm in trying but with a K1 in the mix, your fiancee already has intent to live and work in the US.  Scrapping the K1 doesn't eliminate that intent and the consulate will know her history.

Yeah the embassy won't tell me much, only that she has to be my "spouse" to qualify.  I'd hate to get married go to Poland for this emergency visa then get denied for some reason. Especially since we have been waiting for the K1 for so long already.  Do they look at your intention to come back to your country in a emergency situation?  Because it's clear that tourism isn't the reason, it's safety.

Is your concern about not being able to get an appointment? If your received date is in May, you still have 2 months before you get your 2nd notice. Then another few weeks for NVC. There's at least 3 months left of waiting before the embassy even matters.

My concern is getting my family back to the US as soon as possible.   We are willing to forgo the K1 all together and get married here so she can be considered my "spouse" to be eligible for emergency tourist visa.   But we don't want to do that if there's a chance the emergency tourist visa will be denied.

Visa approval is never guaranteed prior to application.  If you want that emergency tourist visa for your spouse-to-be, the only way to find out if she will actually get it is for her to apply.  Of course it is possible that her application will be denied.  And in my opinion, being unemployed and having a US citizen spouse & child makes her chance of denial higher than most.

I have not come across someone getting an emergency tourist visa, also not aware of any precedent.

 

At least you would be safe in Poland.

You can't bring over an immigrant on a tourist visa.

 

That is fraud, even during geopolitical fracas.
