hi.. lenny!!!

if your husband filled first the 1-130 doesnt problem then when he received first NOA in 1-130 HE filed right away the 1-129f together with photocopy of first NOA of 1-130 DOESn'T problem means thats K-3!! ONLY u need is wait and call the USCIS..

The second if ur husband filed first the 1-129f then he filed 1-130 thats a problem u need to have appointment to nearest USCIS..or hired lawyer to WAIVE ur first case...

I Think your different in our past problem in our case @ USCIS, caz we dont know what form should we filed.when the time were boyfriend and girlfriend he plan to filed the 1-129f package thats for K-1.The forms need fiance here in PI to signature what he did he bring the form in the philippines when he was vacation. while he is here we got married, when the time he go back to the U.S he filed that I-129F @ nearest USCIS,in few months after he filled he havent heard anything!! the he vacation again here in the philippines we go to nearest consulate here in PIask some info. thats the time we know what form should filed for marriage... so we ignored the first petition. then he filed the 1-130 when he received the first noa of 1-130 he send right away the 129f in order to make K-3 and many says that makes expidite..THAT happend when USCIS approved the 1-130 he havnt received the approval notice for about 90days..update online change address, but still they same he havent received when my husband did appoint to nearest USCIS, the officer advise him to hired lawyer to waive the other case....

after he hired lawyer !!!!!!!!! in few days he received the approval of 1-130 and the two I-129F returned to his address...

i hope u learned with my situition !!!

good luck...
