IR-1 BRAZIL EMBASSY - WHO IS GETTING INTERVIEW NOW?

Hello! Is there any way to know what month/year is the Rio de Janeiro Embassy scheduling interviews for IR1 visas? When I checked this website for brazilian's timeframes at the Embassy (Rio de Janeiro) almost everyone had their interview scheduled after one/two months after DQ. Does anybody know when the people that are getting interviews scheduled right now were DQ at NVC? THANKS A LOT! I just want to make sure if this is accurate (I would be extremely happy!) GOD BLESS ALL OF YOU!

My case (actually my son's case) was approved by NVC and sent to Rio's consulate on August 21, 2021. We received the email with the interview date on November 23, 2021 (scheduled to december 16, 2021). But consider that the interviews were suspended until November 8, 2021. So, it seems like family-based visas are being prioritized.

THANK YOU VERY MUCH FOR YOUR REPLY! How long after DQ did they send his case to the embassy? Right after? So it means that maybe it would have been faster for him to have his interview scheduled if he was DQ after November 08? Thank God! Our case is still at the NVC, because we were missing a document. We waited 90 days for them to review the first time, and now it's already 69 days that we are waiting for them to review that only missing document, and finally change our status to DQ. I hope that after getting DQ, we get our appointment letter fast. Thanks a lot!

We do not get to know when they send the case to the consulate after DQ. So, the only time I received news on the case after the DQ status (August) was on November as I told you. But, again, when I had gotten the DQ the consulate was closed to only reopen in November.

I am pretty sure it is faster now.

Hello! After they send the paperwork, does the status change in the CEAC?   Example: Sent to Consulate 

Do they send an email when they send the paperwork to the Embassy?

 
So, do they only send your case to the Embassy when the Embassy requests it? 
 
After 8 months at the NVC: We got DQ TODAY !!!! We are really happy! Anxious for the next step!

So, do they only send your case to the Embassy when the Embassy requests it?

It will list the consulate’s name but it doesn’t say sent to consulate. 

And, yes they only send the paperwork to the consulate when the consulate requests it. So the next time you hear something it will be from the consulate when they are ready to schedule your interview.

I’m not really sure because we are beyond that stage. We just had our 601 waiver approved which won’t require a second interview so I haven’t been following what has been going on interview-wise at the consulate. I do know that they are still behind and are not working at full capacity.

Congratulations for the approval!!!! Do you mind sharing why you needed a waiver? How long did it take to be approved? 

How long after DQ at the NVC did you receive your appointment letter for the interview?
Was the interview hard?

my husband overstayed his tourist visa and he worked while he was here.

We filed our I 130 February 18, 2020. We were approved on August 25, 2021. We were DQ’d on September 21, 2021. From there our paperwork just sat at NVC due to Covid and he didn’t have his interview until July 20, 2021. We filed our 60 one waiver on July 25, 2021 and was received at USCIS on July 29, 2021.

You meant approved on Aug 21 2020, instead of 2021? And DQ'd  September 2020 instead of 2021? 

I’m so sorry that you had to go through this. This process is already long even if everything is 100% perfect! How frustrated could it be to need to file a waiver after waiting all of this time. At least now he won't need to go to another interview. Do you remember what they asked him at the interview? I'm nervous, it looks like our case is similar. 

I  overstayed, but it was less than 180 days. What I heard is that if you overstay less than 180 you don’t need a waiver, but I'm not sure about working. I think I'm going to create a new topic to talk about.this. 

We filed our I-130 July 04 2020, we were approved on July 01 2021 (it took forever). We were DQ´d March 14 2022.

Yes, sorry it was Aug/Sept 2020. (I think we’ve all lost track of time due to Covid!)

They didn’t ask that many questions. They did ask him if he worked while he was here. One piece of advice - never lie to the officers that are questioning you! The interviews are really not that difficult. You’re there forever but it’s because you have to wait in line and fill out forms. But the actual interviewing part is quite short.

It is true that if you overstay for less than 180 days it doesn’t trigger any type of bar in the system and your visa should still be valid (As long as it hasn’t expired)

because you overstayed the visa they may ask you if you worked while you were here. It just depends on the officer questioning you but that certainly could be a red flag for them.

Don't worry, you're not alone. Covid messed up a lot of people's lives. 
I already put all of this information in our I-130, but maybe they will ask again. I hope not!!!! I'll tell 100% the truth! That's why I'm nervous. Yeap! I hope I get a really nice officer, that is having a great day! Do you think that the fact that somebody worked there is a reason for them to request a waiver? Even if you didn't trigger any bars for overstaying? Thank you!!! Good luck to the both of you!! God bless you!
