They were originally going to stay with there father but things have changed and now I need them here in the USA with me. What do I do? Is there a way to get them here while there seperate i30 petitions are pending? I’m so stressed out. I don’t know anything from this point on and no where to contact to find out what I can do to get them here with me and my husband asap!

Do they have Canadian passports?  They can visit you in the US, but they will have to return to their home country to wait out the IR2 visa process.  Basically the same process that you went through to get your IR1 visa.

By the way, do you have the legal documents stating that you have custody and that their other parent has agreed to their immigration to the US?

Yes I do! So they need an ir2 visa which is through i30 petition?

Yes -- after the I-130 petitions for them are approved, they can apply for IR2 visas.  Same process as yours -- submission and review of documents at NVC, medical exam, and interview at the consulate.

Do you have the legal documentation that allows the children to move to the United States with you?

I believe they require separate petitions, starting back from square 1.

Where are you now?

Good luck

There is no realistic ASAP with immigration, unfortunately.  Unless you keep track of time in units of months.

I cannot tell if you are still with your kids or if you already immigrated (you stated you want to bring them with you, but then you also state you want them "here" in the US with you and your husband).  Have you already immigrated, or did you just receive your IR1 visa, or is just your I-130 that is approved?  If the latter, you can delay your process at the NVC stage until your children's I-130s are approved and then proceed together through DQ and interview.

If you have already immigrated, then they will need to wait out the I-130 process.   You can visit them, and if they have their passports and B2 visas or VWP,  they can visit you.

EDIT:  I just saw the post where you stated you are already in the US.

They have to wait out the IR2 visa process.  Has your husband filed I-130 petitions for them yet?

It seems yesterday your visa had been approved and you are awaiting its arrival?

Nothing the Consulate can tell you.

Good that the I 130 has been filed

You will have a stamp in your passport that acts as a temp Green Card and will allow you to go back to Canada and return.

Hi,

Your children will have to go through the same process that you went through.  It will be 1-2 years.

There is no way to expedite.  There is no way to make this faster.

Changing your mind about the kids immigrating after you immigrated does not create an emergency for US immigration.

You have to be patience.

Sorry.

Yes your right about patience. This wasn’t our plan that’s forsure. I thought there was a visa though for temporary stay while it’s pending or is that only for k1 people
