I am trying to file my 2021 taxes as my wife case is under review of NVC due to RFE it seems it won't be DQed either close to mid April or before April and by the time her interview comes the CO can ask about 2021. Now problem is I am out of states and is with her and trying to file my taxes online and it won't process my federal without my NRA wife ITIN. I called a paid service for applying for ITIN but gentleman told me ITIN numbers are taking longer than normal and right now the earliest processing is minimum 7 to 8 weeks. After processing my federal returns I'll get the refund but now my question Can I file my taxes as single although it's not right would it cause any affect on my wife immigration case or what are my other options to show to CO incase my wife ITIN doesn't come in time by the dead line of filling taxes.

You were married in 2021 so NO to filing single.  you may file Married Filing Separately. 
 

On the ITIN route—-You are considered filing on the date the tax return, Form W7, and your wife’s certified ID is sent off to the IRS. It’s not based on when the ITIN gets processed.

Thanks for the reply so it means I can do paper filling without my wife ITIN as it will be on process in the meantime

I am not understanding your question. State how you plan to file

  • Married Filing Separately, or
  • Married Filing Jointly with an ITIN application included with it.
