FB1 Visa issued but want to bring along fiance

Hello,

My FB1 visa has been issued and i am ready to move to the US from the UK in the next week. I am thinking of the best way to have my fiance join me.

We did not get married because of the FB1 status but now that visa has been issued, we are looking at what would be the quickest way for her to immigrate to the US as well as a british citizen after we get married. 

 

Any help would be very much appreciated!

Ok I see thanks for that. We are planning on getting married straight away as I’ve already paid GC fee. 
do you know if it would be possible for her to adjust her status if she comes in the US on her esta visa she’s entitled to as a UK citizen?

the esta visa is only valid for 90 days per trip

You paid CG fee but did you activate your GC (by crossing the US border)? You can't marry prior doing that.

If she plans to use ESTA simply to AOS that's a visa fraud.

But you can sponsor her.  The dates are current for that category, but it still takes more than 90 days to do that. And as a wife of PR she can't be out of status for even one day.

No I haven’t activated yet. My ticket is booked for 19th March. So as soon as i cross the border can I get married or do I have to wait till the green card comes? 
 

ok thanks for that information, I didn’t know that was fraud wow. How are there any estimates to how long PR sponsorship for a wife is taking at the moment? I know it’s hard to say exact waiting times but just curious

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Make absolutely sure to Enter the US first.  Then exit the US and marry.  Marrying could change your visa category.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you are planning for her to travel on ESTA and marry during that trip, you need to keep in mind that she cannot stay and adjust status.

 

She can visit, subject to ESTA admission by CBP, but she cannot live in the US while waiting for an immigrant visa.

No.

One entering on ESTA/VWP with the intent to adjust status can be constitute immigration fraud.

Two only immediate relatives of US citizens and some other groups can adjust after entering on ESTA/VWP. Since she'd fall into F2A after marrying you she won't be eligible to adjust from ESTA/VWP.

Contradictions without citations only make you look dumb.
