Hello All,

 

I have been divorced with my ex for 6 years now and it was a religious divorce. I paid alimony at the time of divorce. 

 

I have visited India last year and at the port of entry Immigration office stopped me and informed that i have a LOC ( look out notice) on my name, 

They handed over me to local police and police served me 41-C notice in a case and took my passport and  let me go.

 

I had to file a petition in concern court and got a interim order to travel back, even when I was flying back IO at airport stopped me contacted concern police station to let me go.

IO told me LOC - Look out notice is only applicable for all the Airports in India but nothing out of county. 

 

Now I am eligible for my naturalization and my concern is if this LOC will show up in background check when I apply for naturalization. 

 

Please share if any one from these forum had similar situation.

N400, Questions 22 to 28 refer to citations received, detainment etc. I presume this refers to citations, detainment etc anywhere and not just within the US. 
 

Personally I would refer to an immigration attorney, especially one who may have experience of working with clients from India and therefore may be aware of this particular law and its implications. I noticed that in Seattle some attorneys offer free consultation.  
 

In other words, I would be cautious completing the N400 and answering these questions with the wrong presumption only to find out that a background check highlights the LOC.

FBI name check does finds it. It may delay your N400 process with FBI (during this time, it sits with the NBC).

As the lookout notice is concerned for only Indian Penal Code(You're told by the CBP officer as per your post), it eventually doesnt impact for you US Citizenship. But there will be some prolonged concerns, delays due to this.

Given your circumstance, working with a lawyer would help you. 

Consult a lawyer before filing (May be for an hour or two).

If you get any RFE(Queries etc) during the process, you may again review it with the Lawyer.

Also take the lawyer to the N400 interview. 

If I am you, I do dare to spend money for filing and a year+ wait time for my citizenship
