I am on a E-2 visa which expires April 2021 and my I-94 expired in Nov 2021. My company's attorneys filed my E-2 renewal/extension in Nov 2021 and provided me with a I-797C Notice of Action. I used the I-797 to go to the DMV and obtain a 1-time, 120 day extension for my drivers license. Unfortunately this extension will expires in mid-March (28 days from now) and as far as I know I will not be granted another extension whilst we wait to hear back about my E-2 extension. Apparently the attorneys expect there to be action on the case sometime between April – June 2022.

 

HELP!` what can i do in this case to avoid beign left with an expired drivers license for several months?

Maybe not practical but the only thing that comes to mind it get a new visa.

The state website says you need evidence of lawful presence in the USA.  Will you have lawful presence after mid March?

I think so yes. My visa will be expired, however my visa extension will be in process. My visa extension request was submitted before the expiration of my i-94 and before the expiration of my drivers license. We are waiting for USCIS to approve the visa extension

You need an I- document that extends your stay.
