The OP may be talking informally when she referred to jobs. If one is invited to give a lecture at a university as a one-off, in one's head, it may be a job, but to the IRS, it may not be.

 

There are forms of non-wage compensation that are commonplace in universities in which the activity does not involve an employer-employee relationship. Examples can include:

  • fellowships
  • honoraria paid for short-term teaching or lecture series
  • royalties paid to inventors of university-owned patents

The latter two usually involve a 1099-MISC not a W2. Agreed that wage income should always result in both a federal W2 and a state W2 (note that some states do not call it W2!). If the fellowship is taxable, it may or may not be wage or bonus income depending on the circumstances.

In support of the affidavit, we’re submitting the following items:
· Complete and signed copy of my spouse’s most recent tax return (2021), 8 pages.
· Forms W-2 for 2 out of his 3 jobs (for the third one, he gets paid by the state, so he doesn’t get a W-2). We don’t get 1099s either (I don’t think) because he’s not self-employed.
· A current employment verification letter from his main job, which contains his salary ($45k) and job title on company letterhead. We’re trying to get a second employment verification letter from his second job, but it has been challenging hearing back from them. Hopefully the one from his main job is sufficient.
· Six recent pay stubs from his main job.

 

We do NOT have copies of our 2021 tax transcript since we recently submitted the tax return, and it might take a few weeks to process. I will write a note about this, in case it helps. Do you think we could submit our AOS at this point?

Many others have posted specific responses to your questions, but I have a general comment.

 

You don't need to submit 2021 taxes for the I-864 until April 19.   Doing so now would mean you will not have to update the I-864 for the interview.  But if your objective is to submit the AOS now to get documentarily qualified as soon as possible, then perhaps it would be best to submit the form with your 2020 tax transcript (with 2020 as the most recent tax year).  So you would enter the total income or agi for 2020, 2019 and 2018 and just include the 2020 tax return transcript.  Include paystubs as evidence of current income.

I went on Wednesday for the interview with my two children and I brought 2020 tax return and they were asking for my W2. The visa application is now in refused  because I didn’t have my W2. They gave me an email to email the W2 so hopefully the status change soon.
