Hi. We’re about to submit our Affidavit of Support Form, and I’d like some feedback from experienced users like you to see if we’re good to go (after I submit, I promise to stay quiet for a bit). Your help has been greatly appreciated so far 🙏🏻


In support of the affidavit, we’re submitting the following items:
· Complete and signed copy of my spouse’s most recent tax return (2021), 8 pages.
· Forms W-2 for 2 out of his 3 jobs (for the third one, he gets paid by the state, so he doesn’t get a W-2). We don’t get 1099s either (I don’t think) because he’s not self-employed.
· A current employment verification letter from his main job, which contains his salary ($45k) and job title on company letterhead. We’re trying to get a second employment verification letter from his second job, but it has been challenging hearing back from them. Hopefully the one from his main job is sufficient.
· Six recent pay stubs from his main job.

 

We do NOT have copies of our 2021 tax transcript since we recently submitted the tax return, and it might take a few weeks to process. I will write a note about this, in case it helps. Do you think we could submit our AOS at this point?

That doesn't make sense.  States issue W-2s.......I was a state employee for years.....and always received a W-2.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Well, then I clearly misunderstood my husband when he explained the reason why he doesn't get a third W2. I'll ask again, but the point is we have 2/3 W-2s now. Hope thats not an issue.  Maybe some more context helps clarify the situation: He works for a university as an instructor, and then for a community college through them. I think this is the reason why...?

I worked for the University of Arkansas for Medical Science.  I don't think your tax package is complete unless he has a W-2.

Federal law requires all employers to send employees W-2 statements no matter how low earnings or wages are. These W-2 statements can be sent in either paper or digital form and must be received by employees no later than January 31 of the following year. Employers must also file a copy of employee W-2s with the IRS.

He might not have one.....but that doesn't mean it is legal.  I assure you that universities issue W-2 forms.  Good luck.   Maybe NVC won't notice.

They always notice.  Been a LOT of cases held up for incomplete set of tax docs.

Dude should have a 1099 or a W2 no matter who he works for.

Another odd thing - tax transcripts show up within two weeks of filing.  Could save a ton of trouble by filing and pulling a transcript.

Be a good idea to send him over here.  I realize he has an idea of how things should be but I’ve seen a lot of delays for this very issue.

Thank you all, really, for trying to help.  He filed tax return on Feb. 6, but still no return or transcript, and I don't wish to delay submitting much more... ANYWAY, regarding W-2s or 1099s, I just found this on his tax return, maybe it tells you something? @Crazy Cat , @iwannaplay54 . Again, I am clueless when it comes to tax stuff, and he gets irritated when I ask him about that third W2 as he says he doesn't have it. From the attachment below, we have the W2s for the last two (blue color), but not the one in orange... makes any sense?

1099goes with the tax return or the file goes nowhere.

Or he can wait a week or so and get the transcript.

Even bank interest 1099’s can hold up a case.

Either a return with ALL W2’s / 1099’s or a transcript, nothing in between.

You have any idea how many times I’ve seen this mistake in the last 16 years here? 😂  Like almost weekly.

1. So, what I'm understanding from your first post, @iwannaplay54, is that for the "Clark V State..." line on the pic I attached, we have to submit a 1099 there (and there *has to be* one), right?
2. Last question/comment: I assume if I wait for the tax transcript, THEN I won't need whatever I am missing anymore, correct? It might be the easier thing for me to do now, then 😢
