K1 sent back to USCIS from NVC

Our K1 was approved on January 4th. Received NOA2 in the mail just a few days later. Then on January 20th our case was approved again and received another NOA2.  No idea why.

NVC received our petition on January 26th. I called again this past Monday to see if it had been put in the system yet. That’s when I was informed that NVC had to send my case back to USCIS on February 3rd. He said my case wasn’t put in the system so they didn’t know why. He also said it’s been happening a lot lately where they’ve had to send them back to USCIS for certain errors etc.

USCIS just received it yesterday so now my status says that the department of state has sent it back for further review.

Has anyone had this happen? Or know why or what could cause this to happen?

I’m just waiting patiently now for the notice in the mail to find out what the heck is going on. If this is a USCIS error, this is criteria for an expedite, correct?

You meant to say that the I-129F petition was approved, not the K-1 visa which comes later after an interview.  It is impossible to guess what the reason was for the petition being sent back to USCIS by NVC, it is definitely not the norm.  It could have been an error on the part of NVC or USCIS staff that triggered this, or something they noticed in the file that needs to be reviewed again.  All you can do is wait and try to contact USCIS to speak to a Tier 2 person and find out what is going on.  I hope it works out in the end, that this is just a slight delay in the process for you.  Good luck!

Were your NOA2s identical down to every number and date?

Everything identical except for the notice date on when it was mailed. Validity timeframe   etc all still the same.

Yes the I-129F. There genuinely is absolutely nothing that would cause it to be flagged or refused on our end. So it definitely has to be some sort of error on their end. But yes, I’m going to call USCIS tomorrow to see if I can get some answers. We have an attorney and she flat out told us she’s never had a petition sent back before haha.

It has happened occasionally in the past.  Many times it is simply a clerical oversight by the USCIS that NVC needs them to correct

That’s what I have read when I googled. I really hope that’s the case here! Only frustration is when I called USCIS the other day they said it could take up to 180 days for something to be reviewed. That’s insane.

could be as simple as some officer forgot to date stamp a page

Yeah I was reading online that happens. I flipped out though when I called USCIS the other day when he said it could take up to 180 for the timeline to correct anything. No ma’am , I’m not having that lol! I’ll put an expedite request in.

Yeah exactly. So that’s what I’ll be doing once I know for sure it’s an error on their end.

Quick update:

Just spoke to USCIS. They said it was sent back for review due to a couple of review sections not being completed. So I said "Okay so what you're telling me is that our officer forgot to check off a couple of review sections?" She said it seems that way. So I then said "So what you're saying is this is USCIS error?". She got very quiet and didn't speak for a second then said yes lol.

She then proceeded to say it can take up to 180 days for resolution etc.  I said nope, I'm not doing that. Already waited a year and this is USCIS error so I will be putting in an expedite request.

I like your spirit. 😁

LOL. I used a word that the dictionary defines as spirit; mettle and VJ bleeped it. Not a naughty word at all. So I edited it to say spirit.
