Timeline

Hi hope everyone is doing well. 

 

I'm currently filling form i-864 on the part of current individual annual income? Would this be 2022 or would it be 2021? 

I'm getting conflicting answers and it's getting me confused.

Current = what will you be making this year (2022)

Okay thanks. So that means it will be recent year 2020, 2019, 2018 and 2021 will just be skipped?

Current annual income for non-self employed individuals is calculated as:

 

Most recent pay period gross income multiplied by the number of pay periods per year.

Example:  If a person CURRENTLY makes $1000 per week, the current annual income is $52,000.00.  What a person earned last year is irrelevant.   Income over the next (future) 12 months is king.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You provide

 

* tax returns (tax transcripts preferred) for your 3 most recent years. It is still too early for some to file 2021, so 2018-2020 as you wrote.    You might later get an RFE for tax year 2021.  
 

* 3 months  of pay check stubs.  So given it is not yet April 1, you will show income records from November and December 2021.

Yes. Thanks so the 3 recent years will be 2020, 2019 & 2018 right? 2020 being the most recent as my husband didn't file tax for 2021 as yet.

2021 isn't filed yet. So we are using his 2020 tax so the other 2 years will be 2019 & 2018. So the past 3 tax years we are submitting are 2020, 2019, 2018.

Yes this is correct if you are uploading the I-864 with supporting financial documents now.  It would also be wise for your husband to scan and email you a copy of his 2021 tax return, W2, 1099s, plus all schedules/forms filed, or he can go online and print an IRS tax return transcript for 2021 a few weeks after filing, so that you can take this information to your visa interview which will likely be well after April 18th.  They may ask for it so it's best to be prepared.  Good luck with the rest of the process!

Yes. He already have his 2021 w-2 which I already have. He will file his tax early so that by the time I'm ready for interview the tax return transcript can be ready. And yes interview will definitely be after April 18.

 

When I'm ready to go to interview we will update the i-864 form with 2021 income so the information can be current.
