Affidavit of Support: I-864EZ or I-864 form?

Sorry for the many questions lately, I just want to do things right. I keep reading about these forms, and still unsure about which one to use at NVC stage:

Criteria to Use Form I-864EZ:

  • Be the petitioner who filed the original Form I-130 on behalf of the intending immigrant (I filled most of it (with him, of course), but this concerns me as a requirement).
  • Have listed only one immigrant on Form I-130 (without any derivative spouses or children); and
  • Be able to show sufficient income to support the intending immigrant based solely on your salary and pension, which amount is shown on the W-2 Form(s) provided by your employer or former employer.
     

OUR SITUATION (context)

My sponsor is my spouse. He made around 41k in 2021 and we're only using his income, no joint sponsor. We don't have any dependants.
My spouse had three jobs in 2021, but I am unsure if he has W2s for all his 3 jobs.
We filed the I-130 TOGETHER (I filed most of the stuff) in May of last year.
 

Should we fill out I-864EZ or I-864 just to be safe? Thanks for your help in advance.

Always safe to use the full form instead of the EZ.  Just leave the asset section blank if income is sufficient.  

 

You mention last year's income.  Note that current income does not come from a tax return.  If your gross income is a thousand a week today, your current income is $52,000 etc. no matter how much you made last year.

Facts are cheap...knowing how to use them is precious...
