I-130 Affidavit of marriage from spouse's relatives in US

Hi,

Is it OK to get affidavits of marriage from my spouse's aunt and uncle who live in the US already who have extensive knowledge of our relationship? Does the fact she has relatives already in the US matter at all here?

Also, does anyone know if affidavits of marriage have to be wet ink or can they be signed and scanned? (and if so, is e-signature acceptable or is it wet ink signature only for the scan?)

Can you submit personal affidavits?  Yes.  Should you submit personal affidavits? No.  Affidavits are extremely weak evidence.....which are useless.  I would avoid them in favor of quality documentation.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I understand that, but we don't have a majority of the "recommended" forms of proof, like financial information, proof of living together, having a child together. We're both young and none of that has applied to us yet because we are still in different countries...none of those things are going to occur until she lives here. So the majority of my proof is going to be other things, such as chat/call logs, pictures of us in person, gift receipts, plane tickets, hotel reservations, affidavits, etc. stuff like that. I figured affidavits wouldn't hurt to throw in there as a tiny little added bonus.

I cant imagine any type of affidavit that you asked about (wet or scanned), be the difference between your application getting accepted or denied. Like the other comment said, its very weak evidence. 

Personally, I did a wet signature for all mine. If you have strong supporting documents with your case, do whatever affidavit you can. If you dont have strong supporting documents, no type of affidavit will help.

Focus on actual evidence of time spent together in person.  If by "plane tickets" you mean boarding passes, those are great evidence of time spent together, as are passport stamps.  Whether your wife having relatives already in the US matters, depends on lots of other factors, including her country of origin, and culture.  In some cases, it can hurt.  What country is she coming from?

 

I'm seconding that affidavits from third parties tend to hurt rather than help.  Concentrate on other things.

 

Pay close attention to the instructions you are reading.  You're looking at a list that follows the words, "In addition to the required..." and "one or more..." not "a majority of."

 

How many visits have you had?  How many days average per visit?  Which country is she coming from?  Whether you need anything else besides some photos and a marriage certificate depends on the answers to those three questions.

Facts are cheap...knowing how to use them is precious...
