No, unless it takes her Total income line to an amount less than needed to qualify.  Her current income does not come from a tax return though.  It comes from her paystub.

Ok, great! Actually the stock gains increased her total income the first year and very mildly decreased her total income the second year, in both cases she is well above the requirement to qualify as a sponsor.

As far as current income goes, I have an employer letter for my mom as well as her pay stubs that I will attach.

Ultimately though I am pretty sure I will have a job by the time the interview happens (already have job applications in progress) and, if that is the case,  plan on giving my wife an updated I-864 to give to the officer.

Yes, accurate.  That you intend to live with her temporarily does not make any of you her dependent.  Note that the full household size of 4 is the income requirement the Consular Officer will use to determine whether Mom is qualified to sponsor.  As this is India, she'll need to qualify based on all three previous tax returns.

Hello. I've received letter from USCIS to correct our I-864 forms. I have one wife and one child (2 years old). Ive filled two separate I-864 forms for them. How should I corectly fill in every form about household? I enclose photo how I filled in, but I dont know what is correct and what is not correct. There is how USCIS wrote us: "Provide a complete and correctly calculated household size for the petitioning sponsor on form I-864".
So,
1. what digits should be writen in my wife's I-864 form in every item from 1 to 8?

2. What digits should be writen in my child's I-864 form in every item from 1 to 8?

Would highly appreciate if someone could help us!!

You've done it correctly except the total should be 3 on each.  Perhaps you used a different program instead of Adobe Reader or Acrobat, as the total automatically populates with those applications.

Thank you so much!! So, I should mark the same way items from 1 to 8 on both forms? ( for my daughter and for my wife?)

Should be the same total but wife is the 1 immigrant on her form plus one dependent.  For the daughter's form, she is the immigrant so you'll have a 1 for spouse and nothing for dependent.

Exactly backwards.  Don't count anybody twice.  Wife is already counted as the immigrant on her form.  Child is already counted as the immigrant on child's form.

Oh, thanks sooo much!!!!!! Maybe you also know how should i respond to USCIS. USCIS wrote like this: "Please include a copy of all pages of this letter with your response". Should I just send amended I-864 forms including USCIS letter or I should also write a letter (cover page) to them saying what i include (i.e. use the same format of a letter (cover page) which we've used with the initial submission).

Hi,

I wanted to keep my case open at the NVC by satisfying the contact requirement:

Can I just put a message in the ask NVC enquiry form that says “I need more time for our case.  This is my record of annual NVC contact.”, will that be enough?

Also, I read in another thread that the DS-260 needs to be submitted within 1 year of the welcome letter, is this an actual requirement ... That is do I need to submit the DS-260 before the year since I got my welcome letter is up?

Thanks

Either is fine, really, but I would go with "dependent child".  There is no age limit on dependents.  Your parent could be your dependent.

Hi I am filling out the DS-260 for my spouse (I am at the NVC stage for my Spouse and two stepchildren, who each have their own approve I-130s). My two step children have their own I-130 petitions, and their own DS-260s.

On my spouse's DS-260, On the questions:

Is this child immigrating to the U.S. with you? Error

Is this child immigrating to the U.S. at a later date to join you?

Will I need to put "NO" on both when listing out my spouse's children (my step children) on her DS-260 as they are not derivatives and have their own petitions, or does either of them need to be YES ?

Thanks!

Yes, they are immigrating together, but YOU are not immigrating.

Ok so regardless that my step children have their on separate petitions and are not derivative beneficiaries of my wife, I will need to put YES for the question "Is this child immigrating to the U.S. with you?" on my wife's DS260 when I list out her children ?

Yes.  The DS260 is an immigrant visa application.  They....ARE....Immigrating.  This answer would be the same derivative or not.

Ok, so regardless of whether they are immigrating based on her petition as derivatives (which they are not) or that they have their own petitions (which they do), since they are immigrating at the same time as her, the answer would be YES ?
