Yep, it´s super confusing. I actually had lawyers review my paperwork and still got the RFE. It sucks...

I don´t think there will be any documentation of foreign income that will be accepted. We are just going to add a joint sponsor and hope for the best.

This member had to submit proof of income even though it was not going to continue in the US. He uploaded on pay stub. He was finally DQ'ed and interviewed a couple of days/weeks ago...

Looking at the instructions on NVC. If your income is below the poverty line you're supposed to upload proof of income... p.s The poster in the thread I linked was using a joint sponsor and was still asked for proof of income. So, even if you add another sponsor you might still be expected to add proof of foreign income.

Evidence of income

If you completed Form I-864I-864A, or I-864EZ and the income reported on this form or your tax transcript reflects income below the poverty guidelines for the year the form was submitted, submit evidence of your income. This can include evidence of current employment or self-employment, recent pay statements, a letter from the employer on business letterhead – showing dates of employment, wages paid, and type of work performed – or other financial data.

Interesting..

My income is from a rental property in Brazil so it´s very difficult to provide the required evidence.

One user suggested that you can simply put "0" under current income so they won´t request any evidence from you and will rely just on documentation from the joint sponsor.

I got the RFE on Friday so I will discuss this in more detail with the lawyers on Monday. I can´t believe they messed this up, I suggested a joint sponsor back in January and they said it wasn´t necessary.

A member @adventures indicated he had written down zero for his current income and they still requested proof of income... I'm wondering if they changed the way they review these I-864s.

Thank you EmTi. Do you know if there is a thread for Feb submissions? I can only find Jan & March currently.

Also: anyone else nervously awaiting DQ who added documents which might have reset the clock?

I can’t find Feb either!

A quick update on my RFE.

I called the NVC and apparently if your current income on form I864 is below the poverty guidelines, you must upload a document in the category PROOF OF CURRENT OR SELF EMPLOYMENT explaining your source of income or lack thereof. It seems to just be part of the red tape because I had uploaded a similar statement under the FORM W-2 WAGE AND TAX STATEMENT document category and still got the RFE

They also confirmed that we go to the back of the line :(

So if anyone here is planning on using assets for their AOS, make sure to upload something under PROOF OF CURRENT OR SELF EMPLOYMENT.

Another interesting thing the NVC told me is that they dont even look at the assets, that part is done at the embassy.... It´s a mess.

Submitted my financial documents on January 28th and got an RFE today with two messages:

1. Please submit evidence of income:

I don´t have a job in the US yet and my income comes from foreign sources which I explained in a letter that I submitted. I sent them a statement with my stock portfoliio as proof of assets which more than covered the income requirements but still got the RFE.

2. This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p.

So it looks like they want a joint sponsor.

By the way, all documents show the status of "Accepted". Does that just mean that they were reviewed?

Hi @Fabio R S,

I had a convo with another member on here ( @EKT ) who was using assets to cover the Affidavit of Support requirements & got a similar message suggesting her income did not meet the requirements and they may need a joint sponsor. From my understanding - as long as all docs are accepted and you get 'DQ'd' then I don't think you have to submit more online - if you've already been notified your case was sent to the local Consulate for interview scheduling then I think you are fine. Just bring a joint sponsor AOS form and evidence to your interview just in case - in @EKT's case I believe they weren't even asked for the joint sponsor affidavit at the interview.

I was kind of under the assumption many of these messages are just blanket statements sent automatically to anyone who doesn't use income for the Affidavit of Support. Again, it's hard to know for sure the many mysteries of the NVC process but this was my conclusion after many hours on VisaJourney lol - and since I too used assets and stock portfolios instead of income, I'm expecting this message as well.

The trick is getting the DQ. All my documents were Accepted but they still requested proof of income and I did not get the DQ email. You are right about the joint sponsor message though, it seems to be sent to everyone who doesn´t meet the income guidelines.

In any case, it seems like they need something uploaded under PROOF OF CURRENT OR SELF EMPLOYMENT to satisfy their checklist if you are using assets. It´s strictly red tape. To be honest, my impression is that the NVC step is just a glorified clerical process with little to no actual document content analysis.

Under the the proof of current / self employment I uploaded the last three pay stubs at my current job (based in NZ and will not continue when I go back to the U.S.) Under the W2 section I uploaded a letter explaining my absence of W2 was because I currently work overseas. I also included correspondence with several employers showing evidence I was looking for work in the U.S. and uploaded under "Proof of domicile" (as well as a laundry list of other things) - Seeing my income won't continue in the U.S. we got the message suggesting uploading or bringing a joint affidavit to the interview to prevent delays, I'm pretty confident we won't need but will have my spouse bring just in case.
