February 2022 - AOS Filers

Timeline

Family based AOS - spouse of USC:

January 8th - I-130 applied online

January 12th - I-797C(Receipt Notice) received thru mail (but you can print it out the next day thru your USCIS acct)

Feb 7th - Packet mailed via USPS (I-485, I-765, I-864, I-693) Arizona lockbox

Feb 9th - Packet Delivered

Feb 26th - Received Text message and Case #'s for 485 and 765

Mar 3rd - Received 797C for both 485 and 765 thru mail

Mar 5th - Received update thru Lawfully that Biometrics schedule has been processed

Mar 7th - Received 797c for Online Access Code for "My USCIS" account of my wife. was able to print out Biometrics schedule

Mar 29th - Biometrics Appointment Schedule (will try to walk-in for an earlier date) We'll update everyone if successful.

 

 

 

My wife tried to have an early Biometrics at our local USCIS office here in Las Vegas. Due to backlog from last year, they are not accepting early walk-ins even if you have a valid excuse that you won't be able to make it on the date that was given to you. But they can accommodate you anytime after your appointment date.  So I guess we'll just wait out our original appointment date! Good Day everyone!!!

Yes 😂 I’m trying to stay indoors but I really want to go to the supermarket 😂 meanwhile, I ask hubby to help me get stuff lol

3 March - Package received at PO Box
8th March - Received text notification for i-485, 131, 765.

12 March - USCIS status check online - "biometrics appt. was scheduled"

Just waiting for everything, NOAs and biometrics mail to come in through the post!

Did you put "0" on Part 5.  no 3  ? I received RFE to correct the household size . 

I am apply AOS for fiancée (now spouse).

My RFE was only for Part 5 #8, as I didn't have the right browser extension to edit the PDF. I had to fill in Part 5 by hand, but the auto-filling filled out #8 as "1" and I forgot to correct it.

 

Your issue is also very common. You are correct, Part 5 #3 should be "0", as you do not have a spouse NOT included in the petition.

Thanks. btw did you send the documents by mail or uploaded on the USCIS site? 

And also is copy of marriage certificate enough our marriage ?

I uploaded to the USCIS site. I think it is quicker than mailing. It has been a month since we submitted the RFE response and a little over 2 weeks since biometrics and we have not heard back yet. 

 

The official instructions state "you must submit a photocopy of your marriage certificate issued by the appropriate civil authority where the marriage took place", so I believe a copy would be fine.

Filed AOS application together with EAD application (no AP).

 

Sent via FedEx: February 17, 2022

USCIS receipt: February 22, 2022

USCIS sent an email they assigned a biometrics appt: March 5, 2022

USCIS sent an email that they're sending us a RFE: March 9, 2022

Received a generic RFE for Affidavit by mail: March 14, 2022

Mailed evidence for the RFE: March 18, 2022

 

Currently we're waiting for USCIS portal to update receipt of our evidence.

 

Biometrics to take place: March 29, 2022

im confused. has she enter USA with that fiance visa? because fiancee visa is void the moment the person enter US soil ( single use ). so the expiry date is irrelevant here
