USC moving to the US during the process

Hi all,

 

We filed our I130 online, received NOA1 on 12-Apr-21, and have been Active Review (in Texas )since October.

 

During the wait, we've both been living and working in the UK as is detailed on our I130. My wife (USC) has now left her job and recently accepted a new position in the US beginning mid-March, and will be moving back shortly before.

 

Do we need to update our I130, and when? Does she need to do it now as she's no longer employed by the organisation on the I130? Or do we wait until she's started the new role?

Looking at processing times, it seems like we're really close to going through to the next stage, so we're a little hesitant to do anything that could lead to further delay.

When I changed address during I-130 still pending at USCIS, I used form I-865 and mailed it in. Received a confirmation of address change (though I never completed I-864, and have yet to do it) but it seems to have made them take a look at it faster (this was in 2012).

hi, similar situation, both in UK where we filed on early April 2021 with a NOA1 of April 14th,  active review since August 31st,  wife USC started working for a US company in September '21 and is moving back in 5 weeks :( was condition of the job offer.

 

we did ask for an expedite request in November 21 this was when we also found out our case had been transferred from Nebraska to Potomac, 4.5 - 7 months to 12+ !  as we tried to do a case enquiry and it wouldn't allow us

 

they took all our details, the thing to note here is that they would not accept a non US address for the expedite so one was given, wife's parents, a couple of weeks later it was denied because the address they had for the expedite didn't match the original address on the I-130, but they wouldn't accept a non US address for the expedite! figure that one out, they must have looked at the original and then simply said no based on address difference rather than the expedite request detials itself, so we been waiting since...

 

although not wanting to hijack your initial question id say addresses are a dark art in themselves let alone processing times

 

we too hoping we are close to some sort of decision

Same situation, but my wife (USC) moved back to the US from UK because her UK visa expired.

 

We didn't update USCIS, just used the new address when submitting NVC information.

 

I'm now DQ'd and no issues have arisen since then - So my advice would be to not bother changing address, as more paperwork means more potential problems!
