I'm Australian and I have been married to a US citizen for the past 6 years and in November 2020, we applied for my daughter's green card. 

 

In mid-2021, my husband and I separated however I continued to live at his house.

 

In October 2021, my husband signed the Affidavit of Support for my daughter and the documents were received on 5 November 2021. 

 

In late November, I moved out of my husband's house as he had assaulted me (not the first time) and I applied for a DVRS (domestic violence restraining order) against him. He is currently awaiting to go to court on another charge (assault against a police officer). 

 

I've now applied for a dissolution of marriage but I'm just wondering how this will affect my daughter's application? We are now just awaiting the NVC to review the documents submitted and then await an interview??

How old is she?

I have already spent about $6K with her immigration attorney and I don't have the $ right this moment to apply for her under my name (I'm a green card holder). 

 

I'm trying to keep a low profile and hope that he doesn't pull the petition. 

 

Divorces usually take 6 months here in California so I am hoping my daughter can get her interview before that happens.

I would think she is looking at 2023 for an interview.

Well you have some time, just seems unlikely that he would not pull the I 864 especially in a divorce situation 

 

And they may well want an updated one for the interview
