Expired Green card reapplication from overseas

No, im getting annoyed because there was no answer, just replies of what i did wrong and how I "should" have done things, not what i can do to actually progress. 
Im thankful to those that have solutions, not pointing out how i screwed up in every way possible. 

I'm just simply asking what are my options outside of attempting to remove conditions and potentially wasting $500 and 6 months waiting to see if it will fail only for me to be kicked out of the US if i enter.  

To answer people asking, yes; I have been filling US taxes while out of the country.

The other option is for your wife to file for you I 130 and you to file a I 407

 

Thst will take time but more certain

Thank you for the information. 

I am still working in Canada at the moment.
My wife misses her family and friends and we would like to return asap but if its not an option to try anything else, then we really have no choice.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

In the context of future retrospect is not helpful in the present, especially because most people falling into my mistakes are probably going to look this up after they have made the mistake themselves.

Not necessarily.  A wise person learns from the mistakes of others...and avoids those same mistakes.  Your thread might provide a great deal of help to others.

As others have said your 24 month extension letter will expire in February 2022.  But maybe you will luck out.  For example if your gc expires February 29, 2020 and you get your extension letter before March 2, you can enter the USA.  You then make an appointment with USCIS to get an I-551 extension stamp on your passport.

So now you have the problem of entering the USA.  About the only option you have is to attempt to enter by land and hope you are processed as a returning resident. If so great.  As with option (1) get the I-551 stamp. If have enough nerve you can even ask the CBP officer for a stamp.  
 

If processed as an arriving alien, you will be invited to file I-407 to abandon your LPR status.  You can inform the officer you wish to contest. If so you will be paroled in. See https://help.cbp.gov/s/article/Article-3671?language=en_US#:~:text=The CBP officer will collect,final determination on your case . You will be able to work and live in the USA while awaiting your removal trial.  

 

3. File I-407 to abandon your LPR status now and your spouse files I-130 to get your LPR status via an IR-1 visa. 
 

With this approach you avoid I-751.

Being ridiculed may be the wrong word but being "preached to" certainly comes to mind when I read through the entire thread. OP already knows he has made a mistake in not filing for ROC. He specifically acknowledges that fact in his second post and asks for a remedial process that Mike E, as he normally does, shares in full context.

 

Good luck Vin&Rachel, please let us know how you get on, successful or otherwise. That will be very useful to anyone who finds themselves in a similar  predicament.

Two year card, you did not apply to remove conditions, and you have been overseas for three years?

This green card is toast.  Have your wife file a new I130 and start over.

On another note been there done that.  We didn’t ask, we just surrendered the card and filed for a new one.

On the bright side you do get a 10 year

your options are none . if you need to come back start by filing i-130 IR 1 and than get an immigrant visa. start the whole process back

Just a note the I-751, ROC (Removal of Conditions) is $680.

The questions you’re being asked by VJ members are a milder version of what you should expect from USCIS. You need some thick skin here. In summary you’re being told that your chances are slim and none and slim is currently out of town. You may just have to go through the whole shebang again.
 

Alternatively you have the option of filing the late 751, while it’s being adjudicated try to reenter the USA preferably by road and take your chances with the border officers and then fight USCIS from within the USA or apply for permanent residency all over again but from within the USA 🇺🇸. It’s better than trying to undergo the whole process from outside the USA.
 

Knowledgeable CJ members can chime in on my proposal.

Just another random guy from the internet with an opinion, although usually backed by data!
