I wanted to get clarification from my congressman office on this.

This is what I questioned my Congressman Office:

Hello, I have a question and I'm not sure if you heard of this or not? Has USCIS changed there process with the I-130 and the I-129F petitions? Alot of people of been getting approvals for the I-130 petitions before the I-129F. Someone had contacted USCIS and it was explained that if you in k3 visa i-130 get approved before i-129f then i-129f is no longer valid. Is this true? What would happen if this would be true? I was under the impression the I-129F would be months faster and I-130 would be approved later.

Can you please clear this up for me?

Here is the response from the Congressman Office:

The K3 visa (I-129F) was created to help reunite families more quickly than the immigrant visa (I-130) process usually permits. Many of the I-130 petitions have been transferred to other Service Centers to reduce the processing time on these applications. Many I-130 petitions have been processed more rapidly than anticipated.

If your I-130 petition is processed more quickly than the I-129F, then this is good news. If your husband has his I-130 interview before his I-129F interview, then that is good news. It means he would enter the U.S. as an immigrant rather than a nonimmigrant.

I will continue to monitor your applications. The California Service Center states in emails to me that they process everything within 6 months of receiving the application. I am seeing them move more quickly than this.

I cannot at this point give you a more accurate estimate of timing on either petition. It is a very fluid situation within USCIS as they seek to process all application types at all Service Centers as quickly as possible.

I will be in contact with you when I have more information.

I do believe they changed there policy. Remember at the end of the month the fees go up. I believe the I-130 is $385 and the I-129F is "free".

12/14/07 K3 is sent to Lima Peru, received case number from NVC.

12/17/07 Lima Peru Embassey receives K3

01/15/08 LEAVING FOR LIMA PERU!!!

01/17/08 8:15 AM Date of Interview in Lima, Peru with my honey!

INTERVIEW WAS APPROVED!!!!
