Need Record of Past i-130 petition

HI All , Thanks in advance for your answers ,

Back in 2009 I petitioned for for then my husband and after filling the application we separated and never had any  contact anymore he is from Kenya. I don't have any records related to the application. We never had a divorce and lost most of his details , I have made request to get copy i-130 Spouse visa I have made in the past using FOIA responded back saying 

 

"The requested records have been forwarded to the National Visa Center and now fall under their purview.
For Immigrant Visa inquiries call (603) 334-0700, for Non-immigrant Visa inquiries call (603) 334-0888.
There is a 24 hour automated system and operators are available 7:00 AM to 12:00 AM (EST) Monday
through Friday. Inquiries can also be made via e-mail at NVCInquiry@state.gov."

 

My question is what options do I have in getting that application, as I plan to marry in the near future and would to like to petition  for my  partner afterwards?

You are still married?  You want to marry someone else?  Why do you need the I-130?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Again, a marriage by someone who was presumably not free to date until recently could indicate that the "courtship" was suspiciously short. (Or you might have to prove the existence of a long affair!)

You need to focus on this (getting divorced) to be able to marry and petition your new spouse.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

We married in kenya after knowing each other for few years through charity work , but have since 2009 have no contact with him nor do I have any records of the Application I made back then . Getting the I-130 Application I made in 2009  I might be able to use those records to  file for divorce as it contains his details . My question is where should I focus to get those records? Thanks in advance

File a FOIA with both USCIS and NVC
 

A bit hard to believe you can’t remember your husband’s basic details.

You can file for divorce in the US without the I-130 petition from so long ago.  Consult with a divorce attorney.  You may be able to proceed with a divorce filing with information you already have.  I assume that you know his name?  Date of birth?  Good luck!

No idea.  I kept scanned copies of every single word we filed since 2007.  I am assuming your next step is contact the Department of State.  Did he ever come to the US?

Your first step is to see a local divorce attorney where you live.  It's likely you only need your husband's full name, date of birth and his city name.  The Divorce attorney will know what you need.  Getting a copy of an I-130 filing would be the most difficult and time consuming way to deal with this.  Usually, that would not be necessary.  

 

You're married.  Marrying again anywhere in the world would be "bigamy" a crime you are well advised NOT to commit.
